The Committee first considered minutes of the ALC Meeting No.6
/14 for confirmation and confirmed and adopted the same without any change.

Case No M-35

The Committee considered the case as per agenda and noted that Technical Authority, DIPP, have re-examined the case based on the clarification submitted to that Department by the firm vide their letters dated 9.4.2013 & 25/04/2013. In their written recommendation No. 7/100/2013/05-TSW dated 6.5.2013, DIPP have stated that the firm submitted a declaration that the export items in the above mentioned advance authorization have different names in FDA Certificate but they are same items as per their records and documents. Similarly, for import items also the firm has furnished declaration that nomenclature mentioned in the above advance authorization and constitution of the approved formulation is one & the same items.

Committee further noted that the TA, DIPP, had called for the shipping bills, export invoice, ARE-1 and declaration for deciding the net weight of the export item and correlated with these papers and noted the following quantity in export numbers:-

Export Item 1, 2 & 3: Net content of each packing 7.66 grams.

This has been verified by TA, DIPP, from the ‘’Chartered Engineer Certificate’ certifying the above weight of export items

TA, DIPP, has also obtained a copy of the approved formula from Drug Authority and declaration regarding import and export items and noted that the firm claimed 0% wastage.

Taking into account all the facts and circumstances mentioned above, based on the written recommendation of TA, DIPP, vide their U.O. No. 7/100/2013-TSW dated 6.5.2013, Committee decided to re-consider the case and approve norms, as under:-

The above decision would supersede the decision by NC vide ALC M.No. 40/83 dated 9.1.2008. This is only for regularization purpose. As the license had already expired, no further imports and exports will be allowed under this license.

RLA concerned may take necessary action under Para 4.7 of HBP as per above decision of NORMS COMMITTEE.

Where A= Quantity of Kraft Paper, Phenol and Methanol allowed for 1.0 mm thickness with average weight 2.15 Kg/Sq. meter

        B= The thickness or weight  per Sq. Meter of Single sided Decorative Aluminium Foil Laminated Sheet (without barrier paper) to be exported

       C= Either the thickness of 1.0 mm or weight of 2.15 Kg +/-2.5% per Sq. Meter of 1.0 mm thickness

    iii) The quantities of items at Sr. No.(2) Aluminium Foil (3) Tissue Paper, (5) Melamine and (7) BOPP Film will remain unchanged irrespective of change in thickness or weight of export product

    iv) The above Formula can be applicable for export product of thickness 0.7 mm also..

    iv) The above Norms/Formula can be extended up to the export product having thickness upto 30 mm.
