The Committee considered the case as per agenda and decided to defer consideration of the case for four weeks for want of detailed justification for enhancement of norms by D/o C&PC (Chem.Div.). The case is re-listed for 8.5.2013.

Case No M-14

NC No.2/14 Dated 10.4.2013 M/ s Divine Stone F.No. 01/83/162/351/AM13/DES-IV

Based on the O.M. F.No.13/23/2012-EOU dated 20.09.2012 from EOU Division, Department of Commerce and the subsequent recommendation of Department of Industrial Policy & Promotion (DIPP) vide their Note dated 8.10.2012, Committee decided to agree the wastage norms and communicated the same to EOU, DOC and the fir, vide letter dated 11.10.2012, for fourteen different types of carved pieces. Subsequently, Norms Committee considered the request of the firm to fix wastage norms, as per Agenda, for the additional three carved pieces, based on the representation of the firm dated 15.03.2013. TA, DIPP vide their letter No.7/257/2012-TSW/47 dated 9.4.2013, recommended norms for the additional three carved pieces. From the recommendation of TA, DIPP, Committee observed that in stone manufacturing, the wastage is generated during the process of cutting, shaping and intricate carving and broadly the processes involves three stages, as under:-

i) Rough Blocks are right angled; (Dressing of the Blocks) ii) Right angles square & rectangular blocks are shaped into variety of shapes of different sizes; iii) The shaped pieces are intricately cared.

The Committee also noted that the average wastage norms for the additional three carved pieces are shown at 53.96% by the firm and that the wastage is based on input basis.

Based on the above, Committee agreed following wastage norms for the additional three carved pieces.

Committee also directed to send a copy of the above to EOU, Division, DOC, with reference to their O.M.No.13/23/2012-EOU dated 20.9.2012, for further necessary action at their end.

Case No M-15

The Committee considered the cae as per agenda and noted that Technical Authority, DIPP, vide their U.O.No.7/100/2013-TSW/47 dated 9.4.2013, have re-examined the case based on the clarification submitted by the firm vide their letter dated 26.3.2013, stating that the firm has submitted a reply enclosing a declaration that Export Items in the above mentioned Advance License and in approved drugs formula are the same and one (there is little difference in description in the two). Similarly, for the import item also, the firm has furnished a declaration that the nomenclature mentioned in the above authorization and ingredients of the approved formulation are the same and one. Committee further noted that the TA, DIPP, had called for the sipping bills, export invoice, etc., and declaration for the quantity export in Kg., as the quantity of export items in the authorization had been mentioned in Numbers. TA, DIPP, has, accordingly, correlated the same and observed the following quantity:-

TA, DIPP, has also obtained a copy of the approved formula from Drug Authority, declaration regarding import and export items and felt that the wastage of 0.50% on bulk raw materials claimed by the firm is reasonable.

Taking into account all the facts and circumstances mentioned above, Committee decided to re-consider the case and approve norms, as under:-

The Committee considered the case as per agenda and noted that the TA, DIPP, vide their U.O.No.7/100/2013/3-TSW dated 1.4.2013 has re-examined the case. Committee noted that TA, DIPP, had called for the shipping bills, along with other details and the net quantity of export item was indicated in the shipping bills and TA, DIPP noted the following quantity packing for the export items:-

TA, DIPP, has also obtained details of raw material specification, approved formula from Drug Authority for various talc and other details. The import items are various perfumes/essential oils used for manufacture of Talc. The norms for talcum powder are already mentioned at SION A-1758, wherein perfumes at the rate of 0.007 Kg. per Kg. of export of talcum powder (subject to 6% FOB value of export), has been allowed.

Taking into account all the facts and circumstances mentioned above, Committee decided to consider the case for fixation of norms and approve norms, as the norms have not yet been fixed so far, as under:-
