Case No M-168(A)

The Committee considered the case as per agenda, along with clarification given by firm. As consumption of inputs given by Central Excise was more than what was applied for by the party, when asked, party clarified that Central Excise have gone by the consumption of inputs required for the production of neat catalyst on 100% basis, whereas party is exporting neat catalyst of 39.4% strength only.. Since the party proposes to export neat catalyst of 39.4% strength only, pro-rata calculations of the data given by Central Excise Authority works out same as given by party except for items at Sl.No. 1,2 & 3.

Though the clarification given by the party appeared to be applicable on inputs at S.No.4,5,6,7,8 & 9, clarification of party was not matching with inputs quantity proposed for import by party at S.No.1,2 & 3. DGFT asked the party to clarify the same. The party has, through email dated 5.2.2013 to DGFT, admitted mistake and wrote that an inadvertent mistake was made by party while applying quantities of these three inputs and furnished the revised quantities of inputs at S.No.1,2,3 viz. Magnesium Powder, Ethanol (Denatured) and Iodin, and reduced input quantities by 60% in these three inputs. Thus, party now revised requirement of these items per Kg. of the export product to 0.081 Kg, 0.405 Kg and 0.0019 Kg, respectively.

In view of the clarifications furnished by the party, Department of Chemicals & Petrochemicals (Chemicals Division), has recommended norms vide their U.O.No.14010/8/2009/Ch.II dated 12.2.2013, for the export of Catalytic preparations viz., Magnesium Dichloride Supported Titanium Catalyst containing Catalyst content 39.40% min. with 60% of Mineral Oil content. Thus, as recommended by the Technical Authority viz., Department of Chemicals & Petrochemicals (Chemicals Division), Committee decided to approve the following norms:-

As consumption of inputs given by Central Excise was more than what was applied for by the party, when asked, party clarified that Central Excise have gone by the consumption of inputs required for the production of neat catalyst on 100% basis, whereas party is exporting neat catalyst of 39.4% strength only.. Since the party proposes to export neat catalyst of 39.4% strength only, pro-rata calculations of the data given by Central Excise Authority works out same as given by party except for items at Sl.No. 1,2 & 3.

Though the clarification given by the party appeared to be applicable on inputs at S.No.4,5,6,7,8 & 9, clarification of party was not matching with inputs quantity proposed for import by party at S.No.1,2 & 3. DGFT asked the party to clarify the same. The party has, through email dated 5.2.2013 to DGFT, admitted mistake and wrote that an inadvertent mistake was made by party while applying quantities of these three inputs and furnished the revised quantities of inputs at S.No.1,2,3 viz. Magnesium Powder, Ethanol (Denatured) and Iodin, and reduced input quantities by 60% in these three inputs. Thus, party now revised requirement of these items per Kg. of the export product to 0.081 Kg, 0.405 Kg and 0.0019 Kg, respectively.

In view of the clarifications furnished by the party, Department of Chemicals & Petrochemicals (Chemicals Division), has recommended norms vide their U.O.No.14010/8/2009/Ch.II dated 12.2.2013, for the export of Catalytic preparations viz., Magnesium Dichloride Supported Titanium Catalyst containing Catalyst content 39.40% min. with 60% of Mineral Oil content. Thus, as recommended by the Technical Authority viz., Department of Chemicals & Petrochemicals (Chemicals Division), Committee decided to approve the following norms:-
