PRO version Dated 12.9.2012 Norms Committee (hereinafter referred to as NC) considered the case as per Agenda and also directions of Hon’ble High Court Delhi in WP (C) No.464/2011 Marble Arts & ORS V/s UOI, a copy of which has been sent to the Office of DGFT, through Department of Commerce, by the Central Government Standing Counsel (CGSC), Delhi High Court. Hon’ble High Court directed Norms Committee to conclude its proceedings on or before 01.10.2012. The Committee took note of the following:-

  1. The reference from Department of Commerce dated 6.4.2011 was considered first time in the meeting No.38/12 held on 26.12.2011 when representatives from Directorate General of Export Promotion (DGEP), CBEC, Department of Revenue, Department of Commerce (DOC) and Department of Industrial Policy & Promotion (DIPP), were present. Representative of DOC was requested to make available complete details of Letter of Permission (LOP) issued to the firm and the complete details of export and import products permitted under the LOP. These documents were received from DOC partly on 5.1.2012 and partly on 16.02.2012. After receiving documents from DOC, same were given to DIPP for study. DIPP advised to discuss in detail in NC meeting.
  2. 2nd meeting of NC was held on 13.06.2012 to discuss the case. Committee opined that as it may not be proper to fix norms for downstream products without looking into wastage in production of main products. Wastage norms at all stages need to be looked into afresh keeping in to account the consumption and production data certified by Central Excise. Thus the following documents were required to be obtained from the firm:- (A) Year-wise consumption of raw material with corresponding production in respect of the items mentioned below, duly certified by central excise, with effect from the issuance of permission by the Office of the Development Commissioner, Noida Export Processing Zone, Noida vide letter No. 12-123/99-100% EOU-I/Auto/2162 dated 16. 06.99 till the date of such production along with the details of the manufacturing process adopted to achieve the same: (i) Irregular/uneven marble blocks into rough marble slabs (ii) Regular/even marble blocks into rough marble slabs (iii) Rough marble slabs into rough marble tiles (iv) Rough marble slabs/tiles into polished slabs/tiles (v) Rough marble slabs into mosaic tiles (vi) Rough marble slabs into border tiles (vii) Rough marble slabs into profiles (B) As the firm has claimed that the tiles of the thickness 10/12 mm. have been manufactured by grinding the tiles of the thickness of 20 mm,

PRO version resulting in a wastage of nearly 50%, the reason, with justification, for the same; (C) Technological reason, along with the justification, for making use of blade of 3 mm. thickness, instead of a blade of lesser thickness, for cutting mosaic tiles of the size 15x15x10 and other products namely Borders, Profiles and Marble tiles; (D) The reason, along with justification, for manufacturing mosaic tiles of the size 15x15x10 mm. from slabs/tiles of the size 310x310x10 mm. obtained from the blocks, instead from waste slabs/tiles generated during one/more stages of the manufacturing process of the items mentioned at Para 2 (A) above; (E) Date of commencement of production of the export items, specified at Para 2 (A) above, and the last date of such production. 3. Accordingly, letter was written to M/s Marble Art, on 29.06.2012, seeking above information at (A) to (E) above in 30 days time. As information was not received from firm a reminder was sent on 9.8.2012. Though firm’s reply dated 9.8.12 was received on 13.08.2012 but they did not furnish year-wise consumption data with corresponding production duly certified by Central Excise as requested in Norms Committee’s letter dated 29.06.2012 and reminder dated 9.8.2012.Two more reminders were sent on 6.9.2012 and 7.9.2012 by e-mail requesting firm to furnish data as requested by NC. Firm replied on 9.9.2012 by email at 19.35 A.M. saying that requisite data was earlier furnished to IBM and also furnished with their letter dated 9.8.2012 which norms committee wants ‘duly certified by Central Excise.’ 4. The NC met again on 12.09.2012 and studied the replies dated 9.8.2012 and 9.9.2012 submitted by the firm. NC deliberated that the Central Excise Certified consumption and corresponding production data is most crucial in this case to decide wastage norms, which firm has not given. Representative of IBM, Shri D.K. Silekar, Mineral Economist, told Committee that firm had never given central excise certified consumption and production data to IBM. Central excise certified data was also not given by firm to NC despite repeated requests. 5. Representatives of Department of Revenue explained that the unit had filed an application for fixation of wastage norms subsequent to the detection of the case of duty evasion by the Central Excise, Nodia. They further explained that on the basis of investigation carried out by the Central Excise, a demand of Rs.20 crore of evasion of duty has been confirmed against the unit. The investigation involved examination of the statutory records of the unit, private records unearthed by the Central Excise and the statement of various persons in the unit. The basic case made by the Central Excise Department is that the unit has clandestinely removed manufactured goods into DTA. After the case was detected, the unit, in defence, is trying to say that there was no such clandestine removal and the quantities of the manufactured goods alleged to be clandestinely removed are actually the wastage generated in their unit. It was also stated that the Central Excise case of duty evasion is based on actual quantity of purchase, production and clearance and not on the basis of any estimation. 6. NC noticed that the unit has been asked repeatedly to submit the consumption and corresponding production data, certified by the jurisdictional Central Excise authority. Despite three reminders, the unit has not submitted data certified by Central Excise authority. In response to the last reminder, the unit vide its letter dated 10.09.2012, has stated that the required data was furnished to the Indian Bureau of Mines who

PRO version had undertaken the study in their manufacturing unit. The unit in the above referred letter has also stated that insistence of data certified Central Excise is unwarranted and untenable as relevant provision of law do not call for the same. Representative of IBM denied and said that at no point of time firm had furnished them central excise certified consumption production data. NC noticed that claims made by firm on wastage cannot be verified in absence of consumption-production data duly certified by central excise. 7. NC carefully considered the case, studied the available documents provided by Department of Commerce and M/s Marble Art and unanimously concluded that the wastage norms can be fixed by the Norms Committee if, and only, if the firm co-operates and provides consumption and corresponding production data certified by central excise. As firm has not provided most crucial data certified by Central Excise Norms Committee is unable to fix wastage norms and therefore rejected the case.
