The Committee considered the case as per agenda. The Committee considered the request of the firm to allow enhancement in the quantities of Glycerol Mono Oleate and Boric Acid based on the revised quantities sought by the firm in the revised ANF 4A (Col.10A of ANF 4A) as informed by RLA, Mumbai vide their letter dated 10.10.2011. The case was discussed in consultation with the Technical Authority, Deptt. of C&PC(Chem.Div), in the meeting held on 28.10.2011 and 17.11.2011. Technical Authority, Department of Chemicals and Petrochemicals (Chemicals Division) vide their U.O.No14010/52/2009-Ch.II dated 28.10.2011 offered their technical comments. The Deptt. of C&PC(Chem.Div) have mentioned that the firm has stated that based on the strichiometric equations, the firm could not manufacture export product by consuming Glycerol Mono Oleate to extent of 0.579 Kg as applied for in their original application. The Committee took into account the material balance, Central Excise Data for 3 years, manufacturing process, chemical equations, molecular formula and molecular weight and the fact that the firm had represented earlier within the permissible time-limit (i.e. within 4 months of communication dated 16.10.2008 of NC decision dated 20.8.2008), and decided to approve the case for enhancement of Item No.2 of import item i.e. Glycerol Mono Oleate as under:-

Only for regularization purpose. As the license had already expired, no further imports or exports will be allowed under this license. The quantities and other descriptions mentioned in NC Meeting No.21/83 dated 20.8.2008 will remain the same.

Note :- The above decision is subject to condition that the firm shall pay duty and interest thereon for the excess quantities consumed by them.

        RLA concerned may take necessary action under Para 4.7 of HBP as per above decision of NORMS COMMITTEE.
