The Committee considered the case as per agenda. He case was discussed in the presence of the Technical Authority, DC(MSME), who opined that the reply sent by the firm vide their E-Mail dated 29.10.2011 regarding % of impurity in the Alluvial Gold imported, was not satisfactory. The Committee directed TA(MSME) to issue a letter to firm accordingly TA informed that they had written to firm. Accordingly the case may be re- listed on 7.12.2011.

PRO version The Committee considered the case as per agenda. The Committee discussed the case in the presence of Technical Authority, C&PC(Chem.Div), who pointed out in the meeting that the Central Excise Certified Data, furnished by the firm was not specifically meant for the export product Pigment Red 122 for which SION was sought by the firm. The data was in a consolidated form for both the export products (Pigment Red 122 and Pigment Violet 19). It was also pointed out by the Technical Authority that the CA Certificate furnished later by the firm was also not found certified by Central Excise Authority. Hence the Committee decided to write to firm to furnish separate individual production and consumption data for the product for which SION was sought by the firm, viz. Pigment Red 122. A fresh D/L issued on 24.11.2011. Accordingly the case may be re-listed on 7.12.2011.

The firm vide letter dated 26.8.2011 and E-Mail dated 14.9.2011 (copy enclosed) has clarified that their export product is 2000 MT Nickel Sulphate (Solution Form) (Nickel Content 5 to 6%) instead of 100 MT Nickel Sulphate (Containing Nickel 100 MT). Accordingly the firm also revised the requirement of import items as under:-

PRO version 32 and also clarified that the quantity of Nickel Concentrate may be varied according to Ni %age and the same may be accounted as per Customs Bill of Entry where the quantity of Nickel Content is declared.

A clarification was sought from RLA, Mumbai, vide NC’s letter dated 23.9.2011. The reply of RLA, Mumbai received vide letter dated 5.10.2011 who has stated that it is a Technical matter, was also kept in view by the Committee.

Based on the written recommendation forwarded by Technical Authority, DC(MSME) vide their U.O.No. 23(5)/2011-Chem dated 14.9.2011 the Committee decided to approve the case as under:-
