The Committee considered the case as per agenda. The Committee discussed, in the presence of the Technical Authority, Deptt. of C&PC(Chem.Div), the letters of Zonal Jt.DGFT, Mumbai, in respect of the above licenses/files, seeking clarification whether the description of export products approved by NC earlier and the description shown in the shipping bills are one and the same or not. Based on the written clarifications vide U.O.No.14010/41/2005-Chem.II dated 3.10.2011 furnished by the Technical Authority, the Committee observed, as under:-

“The item of export indicated in the license is generic in nature whereas NC has also indicated the generic name and composition of the export product. The exporter has indicated the description of export product on the shipping bills, which coincide with the description indicated in the advance licences. Since the exporter has completed the export obligation, no further import and export will be required. Shipping Bills indicate about having consumed the imported inputs as indicated in the norms fixation communication of NC (A list of inputs utilized as per Shipping Bills attached herewith at Annexure-I). As the export description indicated in the advance licences and norms fixation communication of NC do actually conform to the same chemical composition, as clarified by Technical Authority concerned, the Committee observed that the export descriptions mentioned in the norms committee decision and that of relevant shipping bills are one and the same”.

        The above clarification is only for regularization purpose and no further export/import will be allowed under these licences.

        The Committee also noted that in respect of licences at S.No.1, 2 and 3 above, exporter had completed the export obligation before receipt

of norms fixation from NC. RLA concerned may take necessary action under Para 4.7 of HBP accordingly.
