The Committee first considered minutes of the ALC Meeting No.16/11 for confirmation and confirmed and adopted the same without any change.

The Committee considered the case as per agenda. A personal hearing was granted to the representative of the firm on 27.7.2011 in the room of DDG, NC-IV, in which the representatives from DC (MSME) - Shri Dinesh Kumar, Asstt. Director and Shri Pramod Bharti, his colleague from DC(MSME) – were also present. Technical Authorities requested the firm’s representative to provide the following information/documents:-

  1.           Certificate of Analysis for imports

  2.           Central Revenue & Customs Laboratory (CRCL) Certificate

  3.           Data from supporting manufacturer (s)

Further to PH, the case was also discussed in the NC Meeting No.17/12 dated 27.7.2011 (held on 28.7.2011) and the Committee directed to give two weeks time to the firm to reply. An E-Mail has been issued to the firm on 11.8.2011. Accordingly the case may be re-listed on

The Committee considered the case as per agenda. The Committee noted that the case is old one which had already been decided in the NC Meeting No.34/85 dated 22/1/2009 on the basis of the written recommendation of Ministry of PNG. From the earlier decision of Norms Committee in the case, it is seen that M/o PNG had stated earlier that there were no means to certify the correctness of the data furnished by the firm and hence the wastage had been worked out at 1% as against 5% claimed by the firm. Therefore, the Committee decided to maintain status quo and rejected

RLA concerned may take necessary action under Para 4.7 of HBP as per above decision of NORMS COMMITTEE.

The Committee considered the case as per agenda. The case was discussed in the meeting in the presence of Technical Authority (C&PC-PC.Div.). It was noted by the Committee that –

(i) the manufacturing process involved is “Fractional Distillation” and import item and export item have different ‘boiling ranges’, and different products for various specific end use/applications. Thus both products may have same ITC Code, though the products are different;

(ii) The letter dated 23/27.6.2011 received from RLA, Mumbai was also discussed by the Committee and it was observed from Para 1 and 3 of the letter that advance authorizations for items classified under the ITC Code No.27075000 have regularly been issued by RLA, since ITC HS Code 27075000 is not covered under the Show Cause Notice dated 13.3.2007 issued by Central Excise Department; and

(iii) Technical Authority, Deptt. of C&PC(PC.Div) clarified in the meeting that Aromatic Solvent is an “Industrial Solvent” used in various industrial uses/applications.

Hence, keeping in view the above, the Committee, based on the further written recommendations furnished by Deptt. of C&PC (PC.Div.) vide U.O.No. 46011/11/2010-PC.II dated 12.5.2010 furnished to Committee on 28.7.2011, the Committee decided to approve the case based on the recommended quantities or applied by the firm, whichever is less, as under:-
