The Committee first considered minutes of the ALC Meeting No.13/11 for confirmation and confirmed and adopted the same without any change.

The Committee considered the case as per agenda. The representative of Deptt. of P&NG stated that they were not ready with comments of their Ministry today. It was therefore decided to defer consideration of the case for one week for want of comments from the M/o Petroleum and Natural Gas. Accordingly the case may be re-listed on 14.7.2010.

The Committee considered the case as per agenda. The Committee considered the recommendation of Ministry of Petroleum & NG vide their O.M.No.P-19011/7/2010/Supp. dated 28.5.2010 and dated 6.7.2010 regarding insertion of note in Chapter 27 of ITC (HS) Classification for the export of Petroleum Products under SION at A-2687, A-2688, A-2689, A-2690 and A-3625. The chapter note indicates various mandatory BIS specifications for Petroleum Products. It has been indicated by Ministry of Petroleum & NG that Standards notified in Chapter 27 are of relevance for products intended to be used in India, they are not of much relevance to other countries/foreign buyers importing petroleum products from India and the destination country may not necessarily adhere to Indian standards.

        On the basis of recommendation of Ministry of Petroleum & NG, the Norms Committee decided to insert the following addition note under

SIONs at A-2687 to A-2690 and A-3625:

Note:

“The specifications laid down in Chapter 27 of ITC(HS) Classification of Export and Import items may not apply to the export of products in the SIONs at A-2687 to A-2690 and A-3625 so long as the products exported meet the specifications specified by the foreign buyer in purchase order”.
