Supplementary Agenda for the 65th meeting of the Board of Approval to be held on
19th May, 2015, in the Room No. 47, Udyog Bhawan, New Delhi

Item No. 65.10 : Requests for co-developer

(i) Request of M/s. Electronics Technology Parks-Kerala (Technopark) for co- developer in the sector specific SEZ for IT/ITES at Mulavana Village, Kollam District, Kerala, being developed by M/s. Kerala State Information Technology Infrastructure Limited

The above mentioned SEZ stands notified over an area of 18 hectares.

M/s. Electronics Technology Parks-Kerala (Technopark) has submitted a proposal for becoming a co-developer in M/s. Kerala State Information Technology Infrastructure Limited SEZ for construction of total 5 lakhs sq.ft. IT/ITES Building, power/water, road and other infrastructure for the park, over an area of 01.80 hectares.

Co-developer agreement dated 10th April, 2015 entered into with the developer has been provided. Lease Deed dated 10th April, 2015 has also been provided. Lease period is 90 years. The lease shall pay a lease maintenance rent of Rs. 10,000/- per acre per annum to KSITIL for 4.45 acres of land on or before 31st March of every financial year.

DC CSEZ has recommended the proposal.

The request of the co-developer is submitted for consideration of BoA.

Item No. 65.11 : Cases for ratification by the BoA

(i) Request of M/s. Lupin Ltd., a unit in MIHAN SEZ, for extension of Letter of Permission (LoP) beyond 22nd April 2015

The above mentioned unit was granted LoP for setting up of a unit in the above mentioned SEZ, vide LoP dated 23rd April, 2012 for manufacture of pharmaceutical products. The unit had been granted two extensions from time to time validity of last extension which is up to 22nd April, 2015.

The unit has made the following investment/plans:-

(i) The unit has invested total some of Rs. 89.11 crores in the project as on 31.03.2015 (ii) The company has incurred Rs. 20.86 crores for civil construction and erection of plant and machinery, electrical installation etc. since last extension (iii) Reasons given for the delay in implementation of the project is long time required for obtaining approval from Regulatory Authorities in various countries. Only after receipt of final approval from the authorities, which generally takes 24 to 48 months, commercial production can be commenced in the unit. The unit is awaiting such approvals.

(iv) The unit has project build up area of 29000 sq.mtr out of which it has already constructed 9486 sq. meter which comes to 33% of the projected built up area. Further the unit has stated that rest of the building will be constructed by the time they get the product approval from FDAs. (v) The unit has developed certain exhibit batches of 3 products (Ethambutol, Rousvastatin and Lurasodine) and has sought approval from USFDA for marketing the products.
(vi) The unit is filing application to FDA of various countries i.r.o. 50 other products.

The DC SEEPZ-SEZ had recommended the proposal for extension of LoP.

In anticipation of the approval by the BoA, the proposal was considered in the DoC on file and extension has been granted to the unit up to 22nd April, 2016.

The proposal is, accordingly, placed before BoA for ratification.
