िनणय: -MoC&I, नई िदWी 3ारा जारी िनदXश संSया 94 का हवाला देते हुए, अनुमोदन सिम%त ने उ%चत िवचार- िवमश के बाद िनYकष िनकाला िक डीटीए आपूZतकता से एसईजेड इकाई 3ारा ाV ारंOभक सावजिनक पेशकश (आईपीओ) संबं%धत सेवाएं एसईजेड अ%धिनयम 2005 और उसके तहत बनाए गए िनयम; के तहत अ%धकृत संचालन से सीधे जुड़े इनपुट के Kप म2 यो\य नह( हो सकती ह]। सिम%त ने देखा िक ारंOभक सावजिनक पेशकश (आईपीओ) या शेयर; क' िब:ी के मा1यम से धन जुटाना कंपनी क' पूंजी जुटाने क' ग%तिव%ध है और 5जस उ_े`य के लए धन का उपयोग िकया जाता है, वह पता नह( चल सकता है। यह माल के िविनमाण या िनयात के लए सेवाओं के ावधान से सीधे जुड़ी ग%तिव%ध नह( है। टॉक िब:ी के मा1यम से इकाई 3ारा जुटाई गई धनराOश एसईजेड इकाई के एलओए म2 अनुमोिदत अ%धकृत संचालन से जुड़ी नह( है। अनुमोदन सिम%त ने माना

Decision: - After referring to the Instruction No. 94 issued by the MoC&I, New Delhi, the Approval committee, after due deliberation, concluded that the Initial Public Offering (IPO) related services availed by the SEZ unit from a DTA supplier may not qualify as inputs directly linked with Authorized Operations under the SEZ Act 2005 and rules made thereunder. The committee observed that raising funds through an Initial Public Offering (IPO) or sale of shares is a capital raising activity of the company and the purpose for which funds are used may not be ascertained. It is not an input activity directly connected with the manufacture of goods or provision of services for export. The funds raised by the unit through stock sales is not linked to authorized operations approved in the LOA of the SEZ unit. The Approval Committee held that the DSPF filed by the Service based SEZ unit on account of IPO fees services supplied from DTA is liable to IGST and may not be treated as zero rated supply unless meant for authorized operations of the SEZ unit.
