Application of M/s. GE Oil & Gas India Private Limited located at M/s. Festus Properties Private Limited-SEZ forpermission to Operate Cafeteria in their SEZ Unit No. 401, A Wing, Kensington, IT/ITES-SEZ, Powai, Mumbai-400076.

b. Specific Issue on which decision of AC is required: -

Approval w.r.t. Operate Cafeteria in their SEZ Unit at Unit No. 401, A Wing, Kensington, IT/ITES-SEZ, Powai, Mumbai-400076.

c. Relevant provisions of SEZ Act, 2005 & Rules, 2006/Instruction/

Notification :-

In terms of Rule 11 (5) of the SEZ Rules, 2006 which stipulates that —

“The Developer may, with the prior approval of the Approval Committee, grant on lease land or built up space, for creating facilities such as canteen, public telephone booths, first aid centres, creche and such other facilities as may be required use of the unit”

MoCa&l Instruction No. 95 dated 11.06.2019, item No. 3 (a) which stipulates that —

“The facilities as envisaged under the proviso to Rule 11(5) of the SEZ Rules could also be created by a unit for its exclusive use subject to obtaining a NOC from the Developer as well as necessary NOCs / clearances / approvals from the relevant statutory authorities.”

Unit vide letter dated 18.11.2022, stated that, they have been operating cafeteria in unit for the employees.<br>They confirmed that their vendor is serving pre-cooked meals and there is no Live cooking done in the facility<br>whatsoever by the service provider. Only cooked food/snacks are being brought inside which is prepared in the<br>vendor's kitchen. They only warm / heat the food in the café using hot plates/ microwaves and serve cold<br>beverages and snacks. They also have electrical equipment for serving Tea/Coffee.<br>----- End of picture text -----<br>

They confirm that, there is no use of L.P.G., Kerosene Oil, Liquid Petroleum gas, CNG etc. in their cafeteria.

Further, they added, they have fire NOC from Municipal Corporation of Greater Mumbai and they regular in inspection, maintenance and testing of all electrical equipment's and submit every six monthly certificate of maintenance of fire protection system with authorised license agency to Fire Brigade office.

2. In response to this office letter dated 30.11.2022, Unit has submitted following details and documents vide letter dated 12.01.2025:-

• i. There will be No lease/rent charged to the canteen vendor.

• li. Vendor will not avail any tax exemption

• iil. Copy of Vendor Agreement

• iv. NOC from Developer

• V. SO approval and verification of the cafeteria layout and duty paid challan copy for IGST paid for equipment regularly used in Cafeteria.

e. Observation: The proposal was placed before the 74th meeting of approval committee held on 30.01.2025 Wherein , the Committee deferred the proposal of the applicant, as the representative of the applicant was not present.

e. Recommendation:

• e The application of the unit for Permission to Operate Cafeteria in their SEZ Unit No. 401, M/s. Festus Properties Private Limited-SEZ, A Wing, Kensington, IT/ITES-SEZ, Powai, Mumbai-400076.

e Hence, submitted to Approval Committee Meeting for consideration in terms of Rule 11 (5) of the SEZ Rules, 2006 and MoC&l Instruction No. 95 dated 11.06.2019, item no. 3(a).
