िवभाग 1 <ी शLभू दयाल मीना, िविनMद अ0धकारी सी$ज़-एसईज़ेड, पुणे @ टर एज+डा िवषय 7 01 : िद 21.02.2025 को आयो-जत 103 व1 बैठक के कायवृ5 क' पुि । िवचार-िवमश के बाद, सिम0त ने 21.02.2025 को आयो-जत 103 व1 अनुमोदन सिम0त क' बैठक के कायवृ5 क' पुि क'। एज+डा िवषय 7 02: 21.02.2025 को आयो-जत 103 व1 बैठक के कायवृ5 के लए क' गई कारवाई Nरपोट । िवचार-िवमश के बाद, सिम0त ने 21.02.2025 को आयो-जत बैठक के लए क' गई कारवाई Nरपोट नोट क' है। एडीसी ने सू0चत िकया है िक मैसस मांजरी टड फाम एसईजेड म+ कोई भी एज+डा लंिबत नह1 है। एज+डा िवषय 7 03: द मंजीरी टड फाम Fाइवेट लिमटेड - एस ई ज़ेड डेवलपर Pारा F तुत सामQी क' सूची के अनुमोदन के लए आवेदन। िवचार-िवमश के बाद, द मंजीरी टड फाम Fाइवेट लिमटेड - एस ई ज़ेड डेवलपर के F ताव को सिम0त ने एसईजेड िनयम, 2006 के िनयम 12(2), के अनुसार उनके Fा0धकृत FचालनR के लए अपे0त अनुबंध-I म+ िव तृत सामQी क' सूची, -जसका मूKय 16,45,57,438/- Sपये, तथा उ# सामQी पर देय शुKक Sपये 3.09 करोड़ है, जो चाटड इंजीिनयर राजेश खराते (पंजीकरण संUया एम-130154/8) Pारा िव0धवत Fमाणत है, को अनुमोिदत िकया। यूिनट Pारा F तुत सामQी के िववरण के साथ-साथ खरीद िववरण नीचे िदए गए हV;:

Accenture Solutions Pvt. Ltd, SEZ यूिनट (जो ए:ज़ट आवेदन F तुत कर चुक' है) से मूल खरीद मूKय पर FाX िकया जा रहा है।

एज+डा िवषय 7 04: मेसस एस+चर सॉKयूशंस Fा. लिमटेड का मॉिनट[रग ऑफ़ परफॉम^स िवचार-िवमश के बाद, सिम0त ने एसईजेड िनयम, 2006 के िनयम 54 के अनुसार, दूसरे _लॉक अव0ध के पांचव+ वष अथात िव5 वष 2024-25 के लए यूिनट के परफॉमस को नोट िकया। यूिनट ने दूसरे _लॉक अव0ध के पांचव+ वष अथात िव5 वष 2024-25 म+ संचयी आधार पर 349.11 करोड़ Sपये के अनुमािनत िनयात के मुकाबले 443.82 करोड़ Sपये का िनयात हा-सल िकया है। यूिनट ने िव5 वष 2024-25 म+ संचयी आधार सकाराaमक एन.एफ.ई 3816.25 करोड़ Sपये (नेट िवदेशी मूKय (हा-सल िकया है। यूिनट ने 150 कमचाNरयR (पुSष-75, मिहला- 75) को रोजगार िदया है। एज+डा िवषय 7 05: मेसस अमेज़न डेवलपम+ट स+टर (इं0डया) Fाइवेट लिमटेड का मॉिनट[रग ऑफ़ परफॉम^स िवचार-िवमश के बाद, सिम0त ने एसईजेड िनयम, 2006 के िनयम 54 के अनुसार, पहले _लॉक अव0ध के 5 वष अथात िव5 वष 2018-19 से 2022-23 तक के लए यूिनट के परफॉमस को नोट िकया। यूिनट ने पहले _लॉक अव0ध के िव5 वष FY 2022-23 म+ संचयी आधार पर 284.73 करोड़ Sपये के अनुमािनत िनयात के मुकाबले 1009.83 करोड़ Sपये का िनयात हा-सल िकया है। यूिनट ने िव5 वष 2022-23 म+ संचयी आधार सकाराaमक एन.एफ.ई 1001.40 करोड़ Sपये (नेट िवदेशी मूKय (हा-सल िकया है। यूिनट ने 1857 कमचाNरयR (पुSष-1262, मिहला- 595) को रोजगार िदया है। सिम0त ने यह भी पाया िक यूिनट ने भारतीय Sपये म+ FाX भुगतान के बदले डीटीए म+ सेवाएं Fदान क' हV , जैसा िक नीचे बताया गया है: F.Y. The Manjri Stud Farm Private Limited – SEZ Developer After deliberation, the committee approved the proposal of M/s. The Manjri Stud Farm Private Limited – SEZ Developer for list of material detailed in Annexure-I, for Rs. 16,45,57,438/-and duty foregone on the said material amounting to Rs. 3.09 Crores duly certified by the Chartered Engineer Rajesh Kharate, (Registration No. M-130154/8) required for their authorized operations, in terms of Rule 12(2) of, SEZ Rules, 2006. The details of the materials along with the Procurement details as submitted by the unit is as given below;

Accenture Solutions Pvt. Ltd, SEZ unit (who has submitted an exit application) located in the Developer’s premises on original procurement value. Agenda Item No. 04: Monitoring of Performance for M/s. Accenture Solutions Pvt. Ltd After deliberation, the committee noted the performance of the unit for F Y 2024-25 i.e. 5th year of 2nd Block Period in terms of Rule 54 of SEZ Rules, 2006.

The Unit has achieved export revenue of Rs. 443.82 Crores as against projected export of Rs. 349.11 Crores in the 2nd Block period i.e. FY 2024-25. The unit has achieved positive NFE of Rs. 3816.25 Crores in 5th year of 2nd block period on cumulative basis.

The unit has achieved employment of 150 employees (Men-75, women-75).
Agenda 04: Monitoring of Performance for M/s. Amazon Development Centre (India) Pvt Ltd After deliberation, the committee noted the performance of the unit 5 years of the 1st Block period i: e FY 2018-19 to FY 2022-23 in terms of Rule 54 of SEZ Rules, 2006.

The Unit has achieved export revenue of Rs. 1009.83 Crores as against projected export of Rs. 284.73 Crores in 5th year of the 1st Block period. The unit has achieved positive NFE of Rs. 1001.40 Crores in 5th year of 1st block period on cumulative basis. The unit has generated employment of 1857 employees (Men-1262, Women-595).
The committee also observed that the unit has made services in DTA against the payments received in INR as detailed below:

FY Amount in INR (in Lakhs ) 2018-19: 792.83 2019-20 1079.42 2020-21 594.74 2021-22 988.25 2022-23 1076.63 Total 4531.87 Since providing of “Services” in DTA against payment received in INR does not qualify as ‘Services’ as per definition given in Section 2(z) of the SEZ Act, 2005, The unit has made violation of various provision of SEZ Act / Rules and under Foreign Trade (Development and Regulation) Act, 1992. As the Unit has received payment in INR instead of Foreign Currency the Approval Committee directed to issue a SCN for contravening the provision of Section 2(z)(iii) of SEZ Act, 2005.
