The Service Provider will not be eligible for any exemptions, drawback, concessions or any other benefit available under Section 7 or Section 26 of the SEZ Act for creating or operating such facilities. 2. The Unit/ Service provider shall adhere all the necessary approvals / NOCs/ Clearance from the Fire Dept., FASSAI and other statutory authorities, as required for setting up / running of such facility. 3. AGENDA NOTE FOR CONSIDERATION OF THE APPROVAL COMMITTEE

a) Proposal:
Application submitted by M/s. KRC Infrastructure & Projects Pvt. Ltd and Gera Development Pvt. Ltd. (Developer), for approval of list of material required for authorized operation. b) Specific Issue on which decision of Approval Committee is required: Approval of enclosed list of material required for the authorized operations, in terms of Rule 12(2) of SEZ Rules, 2006. c) Relevant Provisions: (i) As per Rule 12 (2) of SEZ Rules, 2006 “The Developer shall make an application, after obtaining approval for the authorized operation under rule 9, to the Development Commissioner, along with the list of goods and services, including machinery, equipments and construction material required for the authorized operations, duly certified by a Chartered Engineer for approval by the Approval Committee”. d) List of Materials for Default Authorized Operations Viz., Infrastructure to be Developed, Maintained, and for upkeep of Infrastructure: The below mentioned material is being procured by the Developer for the purpose of usages in the Developer premises located at the Office /developer premises at S.No.65, Village-Kharadi, Tal-Haveli, Pune. 2 e) Other Information:  Formal Letter of Approval No. F.1/29/2016 Dated 22.02.2017  The developer has submitted list of material, duly certified by the Chartered Engineer S.K Singh & Associates, Reg. no. M-118968/3 Dated 18.09.2001.  The total value of the list of material is Rs. 12,09,388/-  The Developer has submitted that they need the materials for storing Data of the said SEZ.  The Developer has submitted undertaking that the said list of material valued at Rs. 12,09,388.00 (Rs. 12.09 Lakh) will be used only for authorized operation of the SEZ and will be utilized within time limit specified in SEZ Act 2005 and Rules 2006 made there under.  The Specified Officer vide his verification report dated 22.06.2023 has submitted that: i) The Developer has certified that Indigenous Procurement is Rs. 12,09,388 /- ii) Further, as per the verification done from the ledger on 22.06.2023, the SO has ascertained that the Developer is having sufficient Bond Balance of Rs. 108 Crores.

Hence, the same may be considered for approval. (e) ADC’s observation:  Approval Committee may kindly consider the proposal of the Developer for approval of list of material totally valued at Rs. 12,09,388/-(Rs. 12.09 Lakh), in terms of Rule 12(2) of SEZ Rules 2006. ****************** File No.S-SEZ-PRO0KRCG/3/2022-JDCP I/2451/2023 82
