डीटीए 0.02 आयात | oo कुल |. ००० | बांड मूल्य का उपयोग वि=वरण इस प्रकार है: रु. करोड़ में वि=शि?ष्ट तिNमाही रिÃपोर्ट अक्टूबर 2023 से दि‘संबर 2023 प्रारंभिčक जमा 66.85 कर्तव्य भूल गया 0.08 जमा शेष 66.77 निœर्दि‘Eष्ट अधि™कारी के दि‘नांक 27.03.2024 के पत्रों की प्रतिN संलग्न है। निœर्दि‘Eष्ट अधि™कारी ने कहा है कि©, उपरोक्त वि=वरण से पता चलता है कि© इस sea अवधि™ यानी अक्टूबर से दि‘संबर 2023 में केवल आठ लाख चालीस हजार चार ot आठ सात (8,40,487/-) शुल्क माफ कि©या गया है। इसके अलावा, डेवलपर ने अक्टूबर 2023 से दि‘संबर 2023 की अवधि™ के लि9ए जीएसटीआर 2ए जमा कर दि‘या है। एनएसडीएल ऑनलाइन सिØस्टम के साथ रखी गई तारीख के अनुसार जीएसटीआर 2ए के वि=वरण की जांच की गई है। यह पाया गया है कि© RIN अवधि™ के लि9ए अनुबंध ए (माल) के आंकड़े संबंधि™त अवधि™ के जीएसटीआर ae a दर्शा_ए गए आंकड़ों से मेल खा रहे हैं, जबकि© अनुबंध बी (सेवाएं) का डेटा जीएसटीआर 20 A दर्शा_ए गए आंकड़ों से मेल नहीं खा रहा है। इसी अवधि™ के लि9ए जीएसटीआर 2ए (अक्टूबर-दि‘संबर 2023) में दर्शा_ए गए चालान अभी तक उनके कार्या_लय में जमा नहीं कि©ए गए हैं। पूछताछ करने पर, डेवल्नपर मे बताया कि© वे भुगतान के प्रमाण के लि9ए बैंकों में आवेदन करते हैं जो एसईजेड ऑनलाइन प्रणाली में प्रवेश करने के लि9ए अनिœवार्य है और इससे पूरी प्रक्रिĔया में देरी होती है। डेवलपर ने आगे बताया है कि© चूंकि© जीएसटीआर 1 दाखिĖल करने की तारीख और आपूर्तिNEकर्ता_ द्वारा शुल्क के भुगतान की तारीख भी आपूर्तिNE माह के अगले महीने में आती है, इसलि9ए हमेशा बेमेल होने की संभावना रहती है। इसलि9ए वास्तवि=क समय के आधार पर कि©सी वि=शेष क्यूपीआर अवधि™ के लि9ए जीएसटीआर au और एसईजेड ऑनलाइन सिØस्टम में डेटा का मि.त्रान करना संभव नहीं है। बांड मूल्य की जाँच कर ली गई है और छोड़ा गया शुल्क बांड मूल्य से अधि™क नहीं है। e) एडीसी अनुशंसा मेसर्स रोमा बि‹ल्डर्स प्राइवेट लि9मि.टेड-एसईजेड (डेवलपर) की अक्टूबर 2023 से दि‘संबर 2023 की अवधि™ के लि9ए aan के संबंध में निœर्दि‘Eष्ट अधि™कारी द्वारा कोई वि=संगतिN नहीं पाई गई है। इसलि9ए, उक्त अवधि™ के लि9ए डेवलपर के निœगरानी प्रदर्शन को अनुमोदन समि.तिN के समक्ष वि=चारर्थ प्रस्तुत कि©या जाता है। खेमे के आ के के # के के ४ % # ERE

Relevant provision of SEZ, Act, 2006 & Rules: In terms of Rule 12(6), of SEZ Rules 2006 - “The Developer shall maintain a proper account of the import or procurement, consumption and utilization of goods and submit quarterly and half-yearly returns to the Development Commissioner in Form E for placing the same before the Approval Committee”. In terms of Rule 22(4), of SEZ Rules 2006 - “The Developer shall submit Quarterly Report on import and procurement of goods from the Domestic Tariff Area, utilization of the same and the stock in hand, in Form E to the Development Commissioner and the Specified Officer and Development Commissioner shall place the same before the Approval Committee. . Other Information : M/s. Roma Builders Private Limited-SEZ (Developer), has been granted Formal Approval No. F.1/8/2019-SEZ Dated 16.01.2020 for setting up of an IT/ITES SEZ at Hiranandani Estate, Off. Ghodbunder Road, Thane (W)-400607. The QPR were forwarded to Specified Officer for verification. The Specified Officer vide letter dated 27.03.2024 has stated that the QPR submitted by the Developer has been verified and the detailed report in respect of M/s. Roma Builders Private Limited - SEZ (Developer), of the Quarterly Performance Reports for the period October 2023 to December 2023 is as under: Rs. In Crore SR. NO. In Crore QUARTERLY REPORT PARTICULAR October 2023 to December 2023 Opening Balance 66.85 Duty Forgone 0.08 Closing Balance 66.77 Copy of Specified Officer’s letters dated 27.03.2024 are enclosed. The Specified Officer has stated that, the above details it is found that there is Eight Lakh Forty Thousand Four Hundred Eight Seven Only (8,40,487/-} Duty Forgone in this said period i.e. October to December 2023. Further, the Developer has submitted the GSTR 2A for the period of October 2023 to December 2023. The details of GSTR 2A have been scrutinized vis-avis the date maintained with NSDL online system. It is found that the figures in Annexure A (Goods} for the QPR period are matching with those reflected in GSTR 2A of the relevant period while the data in Annexure B (Services) is not matching with the data reflected in GSTR 2A. The invoices reflecting in the GSTR 2A (October-December 2023) for the same period are not yet submitted to their office. On enquiry, the Developer has informed that they apply to the banks for proof of payment which is mandatory for making entry into the SEZ online system and this delays the whole process. The Developer has further informed that as the date of filing of GSTR 1 and also date of payment of duty by the supplier falls in the next month of the supply month, there is always a possibility of mismatch. So it is not possible to reconcile the data in GSTR 2A and that in SEZ online system for a particular QPR period on a real time basis. Bond value has been checked and the duty forgone has not exceeded bond value. e}) ADC Recommendation: No Discrepancy has been found by the Specified Officer with respect to QPR for the period October 2023 to December 2023 of M/s. Roma Builders Private Limited-SEZ (Developer). Hence, monitoring performance of the Developer for said period is submitted before Approval Committee for consideration.
