THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] 23 जसतंबर, 2022 की अपनी अंजतम िांच पररणाम अजधसूचना सं. 6/13/2021- डीिीटीआर ("अंजतम िांच पररणाम") के तहत जनश् चयात् मक पाटनरोधी िुल्क लगाने की जसफाररि की थी। इस जसफाररि को जित्त मंत्रालय द्वारा स्ट्िीकार कर जलया गया था और किनांक 20 किसंबर 2022 की सीमा िुल्क अजधसूचना संख्या 31/2022- सीमा िुल्क (एडीडी) ("सीमा िुल्क अजधसूचना") के तहत जनश् चयात् मक िुल्क लगाया गया था। 2. उक्त पाटनरोधी िांच में, चीन िन. गण. से संबद्ध िस्ट्तुओं के एक सहयोगी उत्पािकों में से एक उत् पािक, झेजियांग तत्संगिन स्ट्टील पाइप कं. जलजमटेड, चीन िन. गण. ने भाग जलया और उसने अपना जनयाातक प्रश्नािली उत् तर िायर ककया। प्राजधकारी ने उत्पािक/ जनयाातक झेजियांग तत्संगिन स्ट्टील पाइप कं. जलजमटेड, चीन िन. गण. के जलए व्यजक्तगत िुल्क की जसफाररि की। ख.
प्रकक्रया

प्राजधकारी द्वारा संबद्ध िांच के संबंध में नीचे िी गई प्रकक्रया का पालन ककया गया है: 4. किनांक 14 किसंबर 2023 को, झेजियांग तत्संगिन स्ट्टील पाइप कं. जलजमटेड, चीन िन. गण. (इसके बाि इसे "आिेिक" के रूप में कहा गया है) ने किनांक 17 जसतंबर 2018 के व्यापार नोरटस सं. 12/2018 (इसके बाि इसे "व्यापार नोरटस" के रूप में कहा गया है) के अनुसार, अंजतम िांच पररणामों की िुल् क ताजलका में सहयोगी उत् पािक झेजियांग तत्संगिन स्ट्टील पाइप कं. जलजमटेड, िन. गण. के नाम में पररितान करके तत्संगिन स्ट्टील पाइप कं.
जलजमटेड, िन. गण. करने का अनुरोध करते हुए आिेिन िायर ककया। नाम में पररितान का अनुरोध करने का उद्देश्य तत्संगिन को अपने मौिूिा नाम में उपसगा झेजियांग के मुकाबले एक िैजिक और जिजिधीकृत िाखा के रूप में मान्यता प्रिान करना है।
5. अनुरोध की प्रकृजत पर जिचार करते हुए और किनांक 17 जसतंबर 2018 के व्यापार नोरटस सं. 12/2018 के संिभा में, प्राजधकारी ने उपरोक्त आिेिन की िांच की और उसके बाि, आिेिन के अगोपनीय पाठ को मूल पाटनरोधी िांच के घरेलू उद्योग/ अन्य जहतबद्ध पक्षकारों को पररचाजलत ककया और ककए गए अनुरोध पर उनकी रटप्पजणयां मांगी ताकक अनुरोध पर उजचत रूप से जिचार ककया िा सके और उत्पािक/जनयाातक के नाम में पररितान करने तक सीजमत मध्यािजधक समीक्षा (“एमटीआर’’) करने की आिश्यकता का मूल्यांकन ककया िा सके। 6. आिेिक के िािों के जखलाफ घरेलू उद्योग या अन्य जहतबद्ध पक्षकारों द्वारा, जनधााररत समय सीमा के भीतर कोई भी अनुरोध/ साक्ष् य िायर नहीं ककया गया था। 7. प्राजधकरण द्वारा किनांक 9 फरिरी, 2022 को एक मौजखक सुनिाई की गई थी जिसमें घरेलू उद्योग और अन्य इच्छुक पार्टायों को भी आमंजत्रत ककया गया था। तथाजप, आिेिक के अलािा ककसी अन्य जहतबद्ध पक्ष ने भाग नहीं जलया और आिेिन पर कोई जनिेिन/आपजत्त नहीं की। आिेिक द्वारा ककए गए जनिेिन नीचे ििा ककए गए हैं और प्राजधकरण द्वारा उन पर जिचार ककया गया है। ग. अनुरोध

8. झेजियांग तत्संगिन स्ट्टील पाइप कं. जलजमटेड, चीन िन. गण. से संबद्ध िस्ट् तुओं का एक उत् पािक था और उसने सीधे भारत को संबद्ध िस्ट्तुओं का जनयाात ककया था। झेजियांग तत्संगिन स्ट्टील पाइप कं. जलजमटेड, चीन िन. गण. को संबद्ध िांच के अनुसरण में प्राजधकारी द्वारा िारी किनांक 23 जसतंबर, 2022 की अंजतम िांच पररणाम की अजधसूचना में सहयोगी संस्ट् था के रूप में जनधााररत ककया गया था। 9. नाम में पररितान करने का उद्देश्य मौिूिा नाम में झेजियांग उपसगा के मुकाबले तत्संगिन को एक िैजिक और जिजिधीकृत िाखा के रूप में मान् य करना है। झेजियांग चीन चीन िन. गण. में प्रांत का नाम है, जिसमें कक तत्संगिन जस्ट्थत है। इसके अलािा, तत्संगिन की फुज़ियान प्रांत में एक ब्ांच है, जिसका नाम "झेजियांग तत्संगिन स्ट्टील पाइप

3 कं. जलजमटेड फुज़ियान ब्ांच" है। यह ब्ांच स्ट्टेनलेस स्ट्टील िेल्डेड पाइप और कफटटंग (गैर-जिचाराधीन उत् पाि) का उत्पािन और जबक्री करती है। यह संभि हो सकता है कक ग्राहकों को इस ब्ांच के नाम की गलतफहमी हो। इसजलए मिर कंपनी और ब्ांच का नाम बिलने का जनणाय जलया गया। यह नाम पररितान होने से सभी आपूर्ताकतााओं और ग्राहकों के जलए कंपनी की छजि और ब्ांड के प्रभाि में एकरुपता आएगी। यह अनुरोध केिल नाम पररितान की श्रेणी में आता है और किनांक 17 जसतंबर, 2018 के व्यापार नोरटस संख्या 12/2018 के तहत कारोबार की मूल प्रकृजत में कोई बिलाि नहीं हुआ है। आिेिन में आिेिक द्वारा जनम्नजलजखत िस्ट्तािेि िायर ककए गए हैं।
क. मूल और निीन कारोबारी लाइसेंस।
ख. नाम में पररितान से पहले और बाि में प्रबंधन की संरचना। ग. समेकन से पहले और बाि में िेयरधारक और संबंजधत व्यजक्तयों के िेयरों का जििरण। घ. कंपनी द्वारा नाम पररितान के जलए पाररत नोरटस/संकल्प।
ड. नाम में पररितान से पहले और बाि में चीन िन. गण. की सािािजनक क्रेजडट प्रणाली से एक् सरेक् ट।
च. िषा 2021 के जलए लेखापरीजक्षत िार्षाक ररपोटा। 10. आिेिन के अगोपनीय पाठ और अजतररक्त िस्ट्तािेिों को घरेलू उद्योग और अन्य जहतबद्ध पक्षकारों को उनकी रटप्पजणयों के जलए जितररत ककया गया था। उन्हें अनुरोध िाजखल करने के जलए पयााप्त समय किया गया था। घरेलू उद्योग या ककसी अन्य जहतबद्ध पक्षकार द्वारा कोई रटप्पणी/ अनुरोध िायर नहीं ककया गया था। 11. झेजियांग तत्संगिन स्ट्टील पाइप कं. जलजमटेड के नाम में तत्संगिन स्ट्टील पाइप कं. जलजमटेड के नाम से पररितान होने से कंपनी में कोई संरचनात्मक पररितान नहीं लाया गया है िैसे: क. कारोबार की लाइसेंस संख्या में कोई पररितान नहीं। ख. िेयरधाररता में कोई पररितान नहीं।
ग. तत्संगिन के प्रबंधन में कोई पररितान नहीं।
घ. तत्संगिन के पते में कोई पररितान नहीं।
ड. संबद्ध िस्ट्तुओं की उत्पािन सुजिधा में कोई पररितान नहीं।
च. संबद्ध िस्ट्तुओं के जबक्री चैनल में कोई पररितान नहीं।

यह जिलय/अजिलय/अजधग्रहण/बंि करने/स्ट् िाजमत् ि संरचना में पररितान का मामला नहीं है। ख) घरेलू उद्योग के जिचार
13. डीिीटीआर ने मूल िांच में घरेलू उद्योग के कानूनी प्रजतजनजधयों के साथ-साथ अन्य जहतबद्ध पक्षकारों को भी पत्र भेिा, और रटप्पजणयां आमंजत्रत की, लेककन न तो घरेलू उद्योग और न ही कोई अन्य जहतबद्ध पक्षकार प्राजधकारी के समक्ष उपजस्ट्थत हुए ऑैर न ही कोई उत् तर/ रटप्पणी िायर की। घ. प्राजधकारी द्वारा िांच
14. आिेिक द्वारा ककए गए अनुरोधों की िांच की गई है। आिेिक द्वारा िायर िस्ट्तािेिों से यह नोट ककया िाता है कक उन्होंने अपनी कंपनी के नाम में पररितान की मांग की है ताकक मौिूिा नाम में "झेजियांग" उपसगा के मुकाबले एक िैजिक और जिजिधीकृत कंपनी के रूप में मान्यता प्राप्त हो सके, जिससे कक ऐसा आभास हो सकता है कक िे एक जििेष प्रांत तक ही सीजमत हैं। 15. िुल् क ताजलका में उत् पािक के नाम में पररितान की आिश्यकता तब उत्पन्न हुई है, िब झेजियांग तत्संगिन स्ट्टील पाइप कं, जलजमटेड, चीन िन. गण. ने किनांक 21 जसतंबर 2022 से अपने नाम में पररितान करके तत्संगिन स्ट्टील पाइप कं. जलजमटेड, चीन िन. गण. कर किया है।

THE GAZETTE OF INDIA : EXTRAORDINARY [PART I—SEC.1] 16. प्राजधकरी यह नोट करते हैं कक यह अनुरोध 17 जसतंबर, 2018 के व्यापार नोरटस संख्या 12/2018 में जनधााररत ितों के िायरे में आता है। इस जस्ट्थजत को घरेलू उद्योग सजहत ककसी भी जहतबद्ध पक्षकार द्वारा चुनौती नहीं िी गई है। 17. प्राजधकारी य ह नोट करते हैं कक स्ट्िाजमत्ि, जबक्री चैनल, उत्पािन, प्रबंधन, कारोबारी लाइसेंस या आिेिक के पते में कोई पररितान नहीं हुआ है। 18. प्राजधकारी सभी पहलुओं पर जिचार करने के बाि, किनांक 23 जसतंबर, 2022 के अंजतम िांच पररणाम सं. 6/13/2021- डीिीटीआर के पैरा संख्या 222 पर िुल् क ताजलका में जनम्नजलजखत पररितान की जसफाररि करते हैं : कॉलम नं. 6 में क्रम सं. 9 पर, उत् पािक का नाम "झेजियांग तत्संगिन स्ट्टील पाइप कं. जलजमटेड" के स्ट् थान पर "तत्संगिन स्ट्टील पाइप कं. जलजमटेड" ककया िाना है। 19. तिनुसार, प्राजधकारी य ह जसफाररि करते हैं कक किनांक 20 किसंबर, 2022 की सीमा िुल्क अजधसूचना सं. 31/2022- सीमा िुल्क (एडीडी) में भी आिश्यक संिोधन ककया िाए। 20. इस जसफाररि के तहत िारी केंद्र सरकार के आिेिों के जखलाफ कोई अपील अजधजनयम के अनुसार सीमा िुल्क, उत्पाि िुल्क और सेिा कर अपीलीय न्यायाजधकरण के समक्ष की िाएगी।

No. 7/28/2022-DGTR – Having regard to the Customs Tariff Act, 1975, as amended from time to time (hereinafter referred to as “the Act”) and the Customs Tariff (Identification, Assessment and Collection of Anti- Dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995 as amended from time to time (hereinafter referred to as the “Anti-Dumping Rules” or “the Rules”) thereof;
A. Background

1. The Directorate General of Trade Remedies ("Authority") had conducted an Anti-dumping investigation concerning imports of Stainless-Steel Seamless Tubes and Pipes originating in or exported from China PR ("subject country") and recommended imposition of the definitive anti-dumping duty vide its Final Findings Notification No. 6/13/2021-DGTR dated 23rd September, 2022 ("Final Findings"). The recommendation was accepted by the Ministry of Finance and definitive duty was imposed vide Customs Notification No. 31/2022- Customs (ADD) dated 20th December 2022 ("Customs Notification").
2. In the said anti-dumping investigation, one of the co-operating producers of the subject goods from China PR namely, Zhejiang Tsingshan Steel Pipe Co., Ltd, China PR participated and filed its exporters questionnaire response. The Authority recommended individual duty for the producer/exporter Zhejiang Tsingshan Steel Pipe Co., Ltd, China PR. B. Procedure
3. The procedure described below has been followed by the Authority with regard to the subject investigation:

On 14th December 2023, Zhejiang Tsingshan Steel Pipe Co., Ltd, China PR (hereinafter referred to as the “applicant”), filed an application requesting for change of name of the co-operating producer Zhejiang Tsingshan Steel Pipe Co., Ltd, China PR to Tsingshan Steel Pipe Co., Ltd, China PR, in the duty table of the final findings, in accordance with the Trade Notice No. 12/2018 dated 17th September 2018 (hereinafter referred to as “Trade Notice”). The objective for requesting change in the name is to recognize Tsingshan as a global and diversified branch as against prefix Zhejiang in its existing name.

Considering the nature of the request, and in terms of Trade Notice No. 12/2018 dated 17th September 2018, the Authority examined the aforementioned application and thereafter, circulated the non-confidential version of the application to the domestic industry/other interested parties of the original anti-dumping investigation and sought their comments on the request made so that the request could be considered appropriately and the need of undertaking a Mid-Term Review (“MTR”) restricted to change of name of the producer/exporter could be evaluated. 6. No submission/evidence against the claims of the applicant was filed either by the domestic industry or other interested parties within the stipulated timelines. 7. An oral hearing was conducted by the Authority on 9th February, 2022. wherein, the domestic industry and other interested parties were also invited. However, none of the interested parties other than the applicant, participated and made any submissions / objection to the application. The submissions made by the applicant are recorded below and have been considered by the Authority. C. Submissions a. View of the Applicant- Zhejiang Tsingshan Steel Pipe Co., Ltd, China PR 8. Zhejiang Tsingshan Steel Pipe Co., Ltd was a producer from China PR of the subject goods and had directly exported the subject goods to India. Zhejiang Tsingshan Steel Pipe Co., Ltd, China PR was determined as cooperating entity in the final findings’ notification dated 23rd September, 2022, issued by the Authority pursuant to the subject investigation. 9. The objective of the change in the name is to recognize Tsingshan as a global and diversified branch as against prefix Zhejiang in an existing name. Zhejiang is the name of a province in China PR, in which Tsingshan is located. Further, Tsingshan has a branch in Fujian province, named “Zhejiang Tsingshan Steel Pipe Co., Ltd Fujian Branch”. This branch produces and sells stainless steel welded pipe and fittings (NON-PUC). It might be possible that the customers may have a misunderstanding of this branch’s name. Therefore, it was decided to change the name of the mother company and the branch. This name change allows to unify the company’s image and brand influence for all suppliers and customers. The request falls within the category of name change only and there is no change in the basic nature of the business as per the Trade Notice No. 12/2018 dated 17thSeptember, 2018. The following documents have been filed by the applicant in the application. a. Original and New Business License. b. Structure of Management pre and post name change. c. Details of shares of the shareholder and related persons before and after the consolidation. d. Notice/Resolution for Name Change passed by the company. e. Extract from Public Credit System of China PR pre and post name change. f. Audited Annual Reports for the year 2021. 10. Non-confidential version of the application and additional documents were circulated to the domestic industry and other interested parties for their comments. Sufficient time was granted to them to file the submission. No comment/submission was filed by the domestic industry or any other interested party. 11. The change in the name of Zhejiang Tsingshan Steel Pipe Co., Ltd to Tsingshan Steel Pipe Co., Ltd has not brought any structural changes in company e.g.: a) No change in business license number. b) No change in shareholding c) No change in management of Tsingshan d) No change in address of Tsingshan e) No change in production facility of subject goods f) No change in sales channel of subject goods 12. It is not a case of merger/ demerger/ acquisition/ hiving off/ change in ownership structure. g. View of the domestic industry 13. The DGTR forwarded the communication to the legal representative of the domestic industry in the original investigation as well as to other interested parties, and sought comments but neither the domestic industry nor any other interested parties appeared before the Authority or filed any response/comments.

From the documents filed by the applicant, it is noted that they have sought the change in name of their company so as to be recognized as a global and diversified company as against prefix “Zhejiang” in the existing name, which may give an impression that they are restricted to a particular province. 15. The need for change in the name of the producer in the duty table has arisen, since Zhejiang Tsingshan Steel Pipe Co., Ltd, China PR changed its name to Tsingshan Steel Pipe Co., Ltd, China PR with effect from 21st September, 2022. 16. The Authority notes that the request is covered within the scope of the conditions prescribed in Trade Notice No 12/ 2018 dated 17th September, 2018. This position has not been challenged by any interested party including the domestic industry. 17. The Authority notes that there is no change in ownership, sales channel, production, management, business license or address of applicant. 18. Having considered all aspects, the Authority recommends following change in the Duty Table at para no. 222 of the Final Findings No. 6/13/2021-DGTR dated 23rd September, 2022:

At SN.9, in Column No.6, the name of the producer “Zhejiang Tsingshan Steel Pipe Co., Ltd.” to be substituted by “Tsingshan Steel Pipe Co., Ltd”. 19. Accordingly, the Authority recommends that necessary amendment may also be carried out in Customs Notification No. 31/2022- Customs (ADD) dated 20th December, 2022. 20. An appeal against the orders of the Central Government arising out of this recommendation shall lie before the Customs, Excise, and Service Tax Appellate Tribunal in accordance with the Act.
