Viraj Prifiles Linmited. located at Survey No. 205/5, NH 46, Near Village-Chirle, Post- Jasai, Taluka- Uran, Dist.- Raigad, Maharashtra was declared as a Customs Area' vide Notification No. 31/2010 dated 06.10.2010 covering an area of 9 acres (36,000 sq. mts) and an area of 4,815 was added vide Notification No. 12/2015 dated 19.03.2015. M/s. Viraj Prifiles Limited was appointed as Custodian & Customs Cargo Service Provider for said Vaishno Logistics Yard CFS respectively in terms of Section 45(1) and 141 (2) of the Customs Act and Regulation 10 of HCCAR, 2009 vide Notification No. 32/2010 dated 06.10.2010 and the same was renewed vide Notifications No. 16/2012 dated 07.11.2012 & Notification No. 06/2018 dated 24.04.2018 which was valid till 04.10.2022. Vide the Notification No. 06/2018 dated 24.04.2018 & subsequent amendment dated 12.06.2018 the change of ownership from M/s. Viraj Profiles Limited to M/s. Kestrel Aviation Pvt. Limited was approved. 2. Now, in exercise of the powers conferred on me under Section 45(1) and 141 (2) of the Customs Act, 1962, I, D. S. Garbyal, Commissioner of Customs, General, Mumbai Zone- I1, Nhava Sheva hereby renew the appointment ofM/s. Kestrel Aviation Pvt. Limitedto be the 'Custodian' of the Imported goods received at the Container Freight Station of Vaishno Logistics Yarduntil these are cleared for home consumption or are warehoused or are transhipped in accordance with the provisions of Chapter VIll of the Customs Act, 1962 for the entire Customs Notified Area. Similarly, M/s. Kestrel Aviation Pvt. Limitedwill also be the Custodian' of the Export cargo brought into said Container Freight Station for examination and stuffing till their exportation through Jawaharlal Nehru Port. 3 Further, in exercise of the powers conferred on me under Regulation 10 of the "Handling of Cargo in Customs Areas Regulations, 2009", 1, D. S. Garbyal, Commissioner of Customs, General, JNCH hereby renew the approval of M/s. Kestrel Aviation Pvt. Limitedas a "Customs Cargo Services Provider" for the above-mentioned Container Freight Station subject to the following conditions;

) The Custodian M/s. Kestrel Aviation Pvt. Limited approved as "Customs Cargo Services Provider" for the said CFS shall abide by all the provisions of the Customs Act, 1962 and the rules under the "Handling of Cargo in Customs Arcas Regulations, 2009" and other regulations, notifications, orders issued there under. The duration of appointment of M/s. Kestrel Aviation Pvt. Limited as ii) Custodian' and as the 'Customs Cargo Service Provider' shall remain valid for a period of ten (10) _years from 05.10.2022 provided the validity of the AEO-LO status of M/s. Kestrel Aviation Pvt. Limited is extended. If the validity of AEO status granted to the CFS is withdrawn prior to the 04.10.2032 or is not extended beyond the present validity date i.e. 08.01.2024, this renewal shall be valid for a period of 5 years from 05.10.2022 instead of 10 Years. (iii) The waiver from execution of Bank Guarantee has been given in terms of regulation 5(3) of HCCAR, 2009 as the CFS has been accredited with AEO-LO status with validity till 08.01.2024. If the validity of AEO status granted to the CFS is withdrawn at any time prior to 05.10.2032 or is not extended beyond 08.01.2024, the Custodian & CCSP M/s. Kestrel Aviation Pvt. Limited shall immediately execute self renewal bank guarantee for the amount, as determined under Regulation 5 (3) of HCCAR, 2009, without any further notice from this office. (iv) The Commissioner of Customs (General), JNCH shall have the Right to review the approval as 'Customs Cargo Services Provider' before the completion of ten year for failure to comply with any of the Regulations of the "Handling of Cargo in Customs Areas Regulations, 2009 or as per the directions of the Government of India.
