MINUTES OF THE MEETING OF EXPORT FACILITATION COMMITTEE (EFC) HELD ON 23.01.2020 at 3:00 PM AT UDYOG BHAWAN, NEW DELHI Meeting No. 10(2019-20) of EXIM Facilitation Committee (EFC) was held under the Chairmanship of Shri Vijay Kumar, Addl. DGFT on 23.01.2020 at 3:00 PM in Room No. 11, H- Wing, Udyog Bhawan, New Delhi to consider the applications for export of ‘restricted’ items. 2. Altogether 35 applications (including 28 deferred cases) were considered by the EFC, out of which 14 cases were approved ( 11 cases were approved post facto), 02 cases were rejected, 01 case was dropped and remaining 18 cases have been deferred due to want of comments/NOC from the concerned administrative Ministry / Department or information from the applicants is awaited. (ii) Approved cases: Written permissions for cases approved by EFC is issued by DGFT(Hqrs.) to the firm(s) with a copy to Regional Authority (RA) concerned, for issue of export license. The applicant are required to submit their application in e-Com system with Regional Authority concerned alongwith permission letter of DGFT(Hars), if not applied earlier, for obtaining export license. No fresh fee is required to be paid. Please note, as per Appendix 2K of FTP-2015-20, the fee for obtaining export license is Rs. 1000/- only (per application) irrespective of item / quantity / FOB value etc. (iii) Approved post-facto : Cases shown as Approved post-facto implies that approval against those cases have already been issued by DGFT (Hars), with the approval of Chairman, EFC in terms of Para 2.51(c) of HBP (Handbook of Procedure 2015-20). In order to facilitate export, Para 2.51 gives power to Chairman, EFC to issue authorization in those cases, which have been discussed by EFC at least once in previous meeting and got deferred, and where NOCs / recommendations have been received subsequently from the concerned agency(ies) with no divergence in views. However, such cases, shall be brought before EFC in its subsequent meeting for approval on ex-post facto basis. (iv) Dropped. Cases shown as Dropped implies that the firm is not responsive to the queries of DGFT or to the concerned Administrative Ministry / Deptt. and has not furnished documents/information/ clarification as called for despite reminders. Such cases are dropped from active agenda of EFC. However, the case can be opened once the documents are received from the firm with fresh date of application. (v) Rejected. Cases which are shown as Rejected implies that the EFC, after consultation with the Administrative Ministry / Deptt., decided not to grant authorisation due to reasons such as, proposal not supported by the concerned technical agency. No further communication will be issued by DGFT(Haqrs) in such cases. However, the firm can request for review of the decision of the Committee before DGFT. (४) Closed. Cases which are shown as Closed implies that the EFC, after consultation with the Administrative Ministry / Deptt. has decided to close the case due to the reason that the proposed item to be exported is ‘Free’ as per the present ITC (HS) Export Policy, 2018 and does not require licence from DGFT. केक कक के
