Vide Notification No. 01/2016 dated 22.03.2016, CFS M/s JWR Logistics Pvt. Ltd., in respect of its Customs notified area admeasuring 1,13,889 SQM has been appointed as Custodian u/s 45(1) & 141(2) of Customs Act, 1962 and registered as CCSP under Regulation 10 of the HCCA Regulations, 2009 for a period of 05 years from 04.02.2016.

2. An additional area admeasuring 19,451 SQM was notified as a “Customs Area” under section 8(a) & 8(b) of the Customs Act 1962 vide Notification No. 09/2019 dated 01.07.2019 issued vide F. No. S/5- Gen/31/2016-17 CFS M. Cell. The permission for commencement of operations at this notified area has been granted vide letter dated 08.07.2019 issued vide F.No. S/5-Gen/31/2016-17 CFS M. Cell. Thus the total area of the CFS M/s JWR Logistics Pvt. Ltd. notified under section 8 of Customs Act 1962 is 1,33,340 SQM.

Now, in exercise of the powers conferred on me under Section 45(1) and 141 (2) of the Customs Act, 1962, I, Istikhar Baig, Commissioner of Customs, General, Mumbai Zone- II, Nhava Sheva hereby renew the appointment of M/s. JWR Logistics Pvt. Ltd. to be the ‘Custodian’ of the Imported goods received at the Container Freight Station of M/s. JWR Logistics Pvt. Ltd. until these are cleared for home consumption or are warehoused or are transhipped in accordance with the provisions of Chapter VIII of the Customs Act, 1962 for the entire Customs Area of 1,33,340 SQM. Similarly, M/s. JWR Logistics Pvt. Ltd. will also be the ‘Custodian’ of the Export cargo brought into said Container Freight Station for examination and stuffing till their exportation through Jawaharlal Nehru Port.

4. Further, in exercise of the powers conferred on me under Regulation 10 of the “Handling of Cargo in Customs Areas Regulations, 2009”, I, Istikhar Baig, Commissioner of Customs, General, JNCH hereby renew the approval of M/s. JWR Logistics Pvt. Ltd. as a “Customs Cargo Services Provider” for the above mentioned Container Freight Station subject to the following conditions;

(i) The Custodian M/s. JWR Logistics Pvt. Ltd. approved as “Customs Cargo Services Provider” for the said CFS shall abide by all the provisions of the Customs Act, 1962 and the rules under the “Handling of Cargo in Customs Areas Regulations, 2009″ and other regulations, notifications, orders issued there under. (ii) The duration of appointment of M/s. JWR Logistics Pvt. Ltd. as ‘Custodian’ and as the ‘Customs Cargo Service Provider’ shall remain valid for a period of ten (10) year from dated 04.02.2021 provided the validity of the AEO-LO status of the CFS extended. If the validity of AEO status granted to the CFS is withdrawn prior to the 07.02.2023 or is not extended beyond 07.02.2023 the validity shall be valid for a period of five (05) year from 04.02.2021 instead of ten (10) year. (iii) The waiver from execution of Bank Guarantee has been given in terms of regulation 5(3) of HCCAR, 2009 as the CFS has been accredited with AEO-LO status with validity till 07.02.2023. If the validity of AEO status granted to the CFS is withdrawn prior to the 07.02.2023 or is not extended beyond 07.02.2023, the CFS shall execute bank guarantee for the amount, as determined, w.e.f. date of expiry of validity of AEO status. (iv) The Commissioner of Customs (General), JNCH shall have the Right to review the approval as ‘Customs Cargo Services Provider’ before the completion of ten year for failure to comply with any of the Regulations of the “Handling of Cargo in Customs Areas Regulations, 2009 or as per the directions of the Government of India.
