PUBLIC NOTICE NO. 75/2020

The area admeasuring 41990.89 sq. mtr. of M/s. Seabird Marine Services Pvt. Ltd. Located at plot no. 70-81, sector 1, Dronagiri Node, Taluka Uran, Distt. Raigad, Maharashtra was declared as a Customs notified area vide Notification No. 05/2004 dated 16.09.2004, 01/2007 dated 17.12.2007. M/s. Seabird Marine Services Pvt. Ltd. was appointed as ‘Custodian’ and ‘Customs Cargo Services Provider’ vide Notification No. 05/2010 dated 15.03.2010, for the area for duration of 5 years, which was further extended vide Notification No. 06/2015 dated 27.02.2015 for a period of 5 years from 15.03.2015. 2. Now, in exercise of the powers conferred on me under Section 45(1) and 141 (2) of the Customs Act, 1962, I, Sanjay Mahendru, Commissioner of Customs (General), JNCH, hereby renew the appointment of M/s. Seabird Marine Services Pvt. Ltd. as ‘Custodian’ of the imported goods received at the Container Freight Station M/s. Seabird Marine Services Pvt. Ltd. until these are cleared for home consumption or are warehoused or are transshipped in accordance with the provision of Chapter VIII of the Customs Act, 1962. Similarly, M/s. Seabird Marine Services Pvt. Ltd. will also be the ‘Custodian’ of the Export Cargo brought into said Container Freight Station, for examination and stuffing till their exportation through Jawaharlal Nehru Port. 3. Further, in exercise of the powers conferred on me under Regulation 10 of the ‘Handling of Cargo in Customs Areas Regulations 2009’, I, Sanjay Mahendru, Commissioner of Customs (General), JNCH, hereby renew the approval of M/s. Seabird Marine Services Pvt. Ltd. as the ‘Customs Cargo Services Provider’ for the said CFS M/s. Seabird Marine Services Pvt. Ltd. subject to following conditions: (i) The Custodian M/s. Seabird Marine Services Pvt. Ltd. approved as ‘Customs Cargo Services Provider’ for the said CFS shall abide by all the provisions of the Customs Act, 1962, the rules of the ‘Handling of Cargo in Customs Areas Regulations, 2009’, and other regulations, notifications, orders issued there under.

(ii) The duration of appointment of M/s. Seabird Marine Services Pvt. Ltd. as ‘Custodian’ and as ‘Customs Cargo Services Provider’ shall remain valid for five (5) years from 15.03.2020.
(iii) The waiver from execution of Bank Guarantee has been given in terms of regulation 5(3) of HCCAR, 2009, as the CFS has been accredited with AEO-LO status, with validity till 14.01.2023. If the validity of AEO status granted to the CFS is withdrawn prior to the scheduled date i.e. 14.01.2023 or is not extended beyond 14.01.2023, the CFS shall execute bank guarantee for the amount, as determined, w.e.f. date of expiry of validity of AEO status. (iv) The Commissioner of Customs (General), JNCH, shall have the Right to review the approval as ‘Customs Cargo Services Provider’ before the completion of five years for failure to comply with any of Regulations of the ‘Handling of Cargo in Customs Areas Regulations, 2009’ or as per the directions of the Government of India.
