DEPB rates

/ADVANCE COPY/   TO BE PUBLISHED IN THE GAZETTE OF INDIA EXTRAORDINARY (PART­I, SECTION­1)   GOVERNMENT OF INDIA MINISTRY OF COMMERCE PUBLIC NOTICE NO. 22 (RE­98)/1997­2002,NEW DELHI: 10th July, 98   In  exercise  of  powers  conferred  under  paragraph  4.11  of  the Export and Import Policy, 1997­2002, as notified in the Gazette of India extraordinary, Part­II­ Section 3 – Sub­ section (ii) vide S.O No. 283(E) dated 31.3.97, the Director General of Foreign Trade hereby makes the following amendment in the Handbook of Procedures (Vol.1) (RE­98), 1997­2002. 1. The description of export product as given in Appendix 28A against the following serial numbers of product group ‘Chemical’ mentioned below shall be amended as follows:     S.No. of export product Export Product DEPB rates Value cap for calculating DEPB entitlement   501 Carbofuron Granules 19     502 Chlordane 16   503 Chloropyriphos 19

530 Triazophos Technical 14     842 Acephate Technical 14     844 Dimethoate 8     846 Endosulfan 12     847 Fenvalerate 14     848 Phosphamidon technical 9     849 Quinalphos formulations 6     875 Quinalphos Technical 6     882 Carbendazim 14     The description of export product as given in Appendix 28A at S.No. 47(a) of product group ‘textile’ shall be amended to read as under: a. Fabric/ sarees made out of one or more manmade filament yarn with or without metallised yarn. 1. The description of export product as given in Appendix 28A at S.No. 267 of product group ‘Engineering’ is amended to read as ‘Rear/Front engine autorikshaw in CKD/SKD/CBU condition’. 2. The description of export product as given in Appendix 28A at S.No. 57 under the product group ‘ textile’ shall be amended to read as under: 57(a)  Polyester­Woollen  yarn  (Polyester  content  not  less than 55% by weight).   (b) Polyester­Woollen blended yarn (Polyester content less than 55% by weight).

3. The following amendment shall be made in paragraph 5 and 6 of Appendix 16B of Handbook of Procedures (Vol.1) (RE­98) 1997­2002:­     "5. The unit shall also be subject to the conditions stipulated and required for availing exemption from duty of Customs and Excise under the relevant Customs & Excise Notifications and any Customs Duties/Excise Duties and interest payable/leviable to Government for failure to fulfill such conditions shall also, without prejudice to any other mode of recovery be recoverable in accordance with the provisions of Section 142 of the Customs Act 1962/Section 11 of the Central Excise and Salt Act 1944 and rules made thereunder and/or from any payment due to the Unit from the Government.   6 In the event of the unit failing to achieve the stipulated Net Foreign Exchange earnings as a percentage of exports and to fulfill the export obligation undertaken by it as aforesaid except when the fulfillment of such obligation is prevented or delayed because of any law, order, proclamation, regulation or ordinance of the Government, the Government shall be free to issue any directions to the unit regarding the manner of disposal of the export goods and the unit shall be bound to comply with the same. This will be without prejudice to any other action which may be taken against the unit under the provisions of the of Foreign Trade (Development and Regulation) Act, 1992".   The heading of Appendix 32B shall be amended to read as `List of IS/ISO 9000 (series) Certification agencies/WHOGMP certification Agencies/HACCP Certification agency’.   Corrigendum to Public Notice No. 15(RE­98)/1997­2002 dated 8.6.98:

S.No. 15 may be added before the name ‘TUV Bayren (India), 312, Neelkhant Commercial Centre, Sahar Road, Sahar, Mumbai­ 400099"   Attention is invited to Appendix 52 of Handbook of Procedures regarding submission of information for fixation of DEPB rates. It has been decided that all applications for fixation of DEPB rates shall henceforth be routed through the concerned Export Promotion Council which shall verify the FOB value of exports as well as the international price of inputs covered under Standard Input Output Norms. Such application shall be considered only for export products which have an export of Rs. 20 crores or more.   This issues in public interest.   (N.L.Lakhanpal) Director General of Foreign Trade Copy to all concerned, By orders etc. (Ajay Sahai) Dy.Director General of Foreign Trade   (F.No. PRU/AS/98­99/ DEPB )
