Request: Amendment of SION H-97 – clarification from PC-III.

Decision: DGFT had issued Public Notice No. 14 dated 09.08.2012 for amendment in SION H-97 relating to Flexible Intermediate Bulk Containers (FIBC) based on the comments furnished by D/o C&PC vide OM No. 46011/37/2012-PC.II dated 30.04.2012. Subsequently, a reference was received from Policy Cell – III Section seeking comments of NC – 5 (Textile) and NC- 7 (Plastic) whether export product FIBC is covered under Chapter 39 or under Chapter 63.

  1.     Based on the representation, the case was placed before NC again and following were discussed:


     (i)         Whether FIBCs are classified under Chapter 39  or Chapter 63 or whether fixation of norms comes under NC – 7

or NC – 5 ?

Technical Representative of D/o C&PC informed that Plastic Products are scattered under various ITC (HS) Chapter. FIBC is 100% a Plastic Product and can be classified both under chapter 39 and 63. However, the specific ITC (HS) code of export product is 63053200, which appears in Chapter 63. He further stated that, FIBCs which are generally made of Polypropylene Polymer are to be used for both packaging of food grains, industrial raw materials and other items in bulk packaging of 100 kgs or more to be lifted by material handling equipments. FIBC comes under the jurisdiction of Plastic Export Promotion Council (PEPC). The request of various firms for amendment in SION H-97 (Export Product FIBC) was also forwarded by PEPC. He handed over the list of items covered under the jurisdiction of PEPC stating that he got the list from PEPC. He further stated that in this case the norms were rightly recommended by their Department as the product FIBC comes under Plastic Product category.

It was also pointed out by the Division that in past, NC-7 had dealt cases relating to fixation of norms of FIBC in respect of M/s Flexituff International Ltd. (F. No. 01/84/50/171/AM12, 01/84/50/266/AM12, 01/84/50/298/AM12) and M/s Shankar Packaging Ltd. (01/84/50/336/AM11, 01/84/50/343/AM11, 01/84/50/14/AM12 and 01/84/50/196/AM12)

PRO version were initially received in NC-5, as the product was classified under 63053200. NC-5 Division transferred these cases to NC-7 Division as the export product is a plastic product; where in the description of export product, the content of import items namely PP Granules, UV Stabilizer and Non Woven have been indicated which relates to Plastic Product. These cases were also decided by NC-7 based on the comments furnished by D/o C&PC.

(ii) Whether any further data required for amendment in SION H-97 ?

The issue regarding furnishing of data by various firms in prescribed proforma for revision of SION was discussed and the Representative of D/o C&PC informed that they had furnished their comments based on the data available with them vide OM No. 46011/37/2012-PC.II dated 30.04.2012 and hence no further industry data is required. He also informed that basically the wastage has been kept same as the wastage given in earlier SION H-97. He also stated that their further reference dated 15.10.2012 is in respect of general process of fixation of norms, where data is required and in this case of FIBC, as there is no change in the wastage norms, they did not require any further data. Accordingly, they furnished their comments with due approval of Competent Authority.

  1.     In view of above, the Committee decided that there is nothing wrong in the norms which have been amended vide Public

Notice No. 14 dated 09.08.2012 based on the comments furnished by D/o C&PC OM No. 46011/37/2012-PC.II dated 30.04.2012.

  1.     Since, an issue has been raised whether FIBC comes under Chapter 63 or 39, or whether it comes under NC – 5 or NC –

7, it was decided that the issue may be submitted to DG on file with complete facts.

  1.     Policy Cell – III has sought comments of NC-5 and NC-7.  For deciding issue, in order to provide benefits under Chapter 3

or not, PC-III may obtain comments of PC-II Division as product classification under ITC (HS) is actually decided / clarified by PC- II Division only.
