The committee deliberated in detailon the request of the firm, DRlcommunication, provisions of the HBp 2015- 2020. lt was observed by the committee that under para 4.06 AA is issued only after fixation of ad-hoc input output norms by the NC. Therefore, contention/urgency reported by the firm about arrival of the ,consignment and demurrage do not have any merit. lThe committee also discussed the concern of the DRI in the matter and observed that in the present 'application the export item is "Roasted or UnroastedBetel(Areca)Nut(Supari)Sorted / Split / Tukda(pieces) / Farch(Fadcha )/ Sweet / Sliced(Salli) / Graded". Committee also noted that the firm is registered under Central Excise. Based on taking cue of the internal Committee constituted in DGFT, following is the decision of the NC(Norms Committee):- To allow the ad-hoc norms on net-to-net basis with accountability clause subject to following t conditions:- （ 　 〓 ‐ ‐ ‐ ， 　 ‐ IParty Name:C B INDUSttRIES′ 」AM NAGAR Status: Decided :. :l. :i!. The variety/origin/grade of the Betel(Areca) nut will be the same in export product as imported. Central Excise of the unit shall monitor the utilization and thus will verify and certify the actual use of imported inputs in the export product. Firm will give an undertaking that the norms now allowed i.e. net-to-net with accountability clause will be the final and no request for modification/enhancement will be made in any circumstance. The firm will ensure that there will be no diversion whatsoever of the imported item in domestic market or otherwise. Customs may, at the port, take steps as they deem fit for verification to ensure usages of imported item(s) in export product including lab test of export sample. The import of Betel Nut (Supari) Split shall be subjected to prior import condition and export should be made within 6 months of date of import without any further EO extension. lmport and exports should be made from same port. While issuing the Advance Authorisation the Regional Authority will send two DO letters (a) to Commissioner of Customs of port of registration and (b) to the jurisdictional Central Excise authorities to exercise maximum supervision on the import, export and manufacturing. No. 01 dt. 01.04.20L6. The inputs sought for import are not physically getting incorporated in three export products as evidenced from the flow chart and there is no clarity of nexus between the import item claimed and resultant export product and the basis on which ad-hoc norms has been allowed this input, if explained will make the issue more authentic. The inputs claimed are high duty rate item and incidentally import are not allowed from China as per Notification No. 12 dt. 24.06.2016 . Processed Cheese has to be manufactured from cheddar Cheese. However, Cheddar Cheese has to be manufactured from RCM prepared using butteroil imported. This is not clear as per flow chart provided. Moreover, good quality Cheddar Cheese cannot be prepared from pure RCM. The quantity of butteroil data to be imported is sufficient for manufacture of said quantiy of Ghee, Mozzarella Cheese and Paneer to be exported. However, quantity of butteroil to be imported for processed cheese manufacture is reported as 106.07MT, whereas the actual figure is 0.13 x 392 = 50.96MT. Further, in your earlier application, the indigenous lnputs have been mentioned N/A under Column 18 of Appendix 4E. .
