AGENDA NOTE FOR CONSIDERATION OF APPROVAL COMMITTEE

a) Proposal: -

Requested for waiver of Show Cause Notice ir.o 47 Monitors not returned by employees allotted for work from home during COVID.

b) Specific Issue on which decision of Approval Committee is required: - M/s. LTIMindtree Limited (LOA No. SEEPZ-SEZ/NEWSEZ/SERENE-THANE/ MINDSPACE-AIROLI/61/LTIL/2019-20/10581, dt. 22.05.2019) procured 500 nos. Monitors without payment of IGST. National Lockdown was declared on 24 March, 2020 and before the SEZ operations goes under lockdown, as per business requirement monitors were issued to employees to enable them to work from home. Out of 500 monitors, they could not collect 47 monitors from the employees who have left their organisation. Therefore, Unit has requested for waiver waiver of Show Show Cause Notice in this matter. c) Relevant Provisions :-

Rule 43A of SEZ Rules, 2006.

Other Information:-

The Specified Officer, MBPPL-SEZ stated vide their letter dated 23.09.2024 as under:

1. Unit (M/s. LTIMindtree Limited) informed to SO, MBPPL-SEZ vide letter dated 13.09.2024 that, they procured 500 monitors from M/s. Micropoint Computers Pvt. Ltd. in Mindspace SEZ under invoice No. SLS-3965/19-20 dated 06.01.2020 vide Gate entry No. 2568 dated 06.01.2020, DTA Procurement No. 6000777 dated 18.03.2020. The value of 500 monitors as mentioned in the invoice is Rs. 42,25,000/-.

2. As per their business requirements these monitors were issued to their employees to enable them to work from home and employees were allowed to carry these assets. M/s. LTIMindtree Ltd. further informed that out of these 500 monitors, they could not collect 47 monitors from the employees who have left their organisation.

3. They are in process of relocation of their unit and need to handover the possession of premises to the developer and therefore, requested for waiver of Show Cause Notice in this matter. They are willing to pay applicable duty and fine / penalty on subject assets.

4. Duty has been calculated by on the subject 47 assets and it comes out to be Rs. 71,487/-.

Unit vide their letter dated 14.10.2024 submitted No Dues Certificate in respect of relocation of their SEZ unit located Mindspace-SEZ to LTIMindtree SEZ. Specified Officer vide No dues certificate dated 11.10.2024 informed that office of the Development Commissioner regarding non return of 47 monitors given to employees for work from home, against this they have paid the applicable duty and for FTDR contravention, the matter has already been referred to UAC for necessary decision.

d) ADC Recommendation :-

The unit has mentioned that out of 500 monitors, they were not able to collect back 47 monitor. However, it is not clear whether it is only monitor or computer. Proposal is placed before UAC for discussion.
