AGENDA NOTE FOR CONSIDERATION OF THE APPROVAL COMMITTEE a) Proposal : Proposal submitted by M/s. Edicon Pneumatic Tool Company Ltd., manufacturing unit Located at MIDC-Kesurdi SEZ for installation of rooftop Non-conventional Solar power Plant, for captive consumption with availing of duty benefits, for captive consumption. b) Previous Reference: The unit vide their letter dated 06.02.2024 the unit vide their letter dated 06.02.2024 requested for the permission for Installation of Rooftop Non- Conventional Solar Power Plant for captive consumption at SEZ unit. The same was approved by the approval committee in its meeting held on 09.02.2024. Accordingly, the unit was issued approval letter dated 20.02.2024, and the unit was not allowed to claim any duty benefits for the installation of rooftop Non- conventional Solar power Plant. Now, MOC&I has issued Officer Memorandum dated 07.03.2024 stating that, “Duty benefits under Section 26 of SEZ Act, 2005 is allowed to the units for installation as well as O&M of renewable energy equipment exclusively for captive consumption of the unit with a specific condition that the power shall not be wheeled out to DTA.” c) Current Application: In view of the O.M. dated 07.03.2024, issued by MOC&I, the unit vide their 08.02.2024, has requested for permission to avail duty benefits for installation of rooftop Non-conventional Solar power Plant at their SEZ unit against the approval letter dated 20.02.2024 issued to them. The unit also informed that, they have not procured any material required for the installation of rooftop Non- conventional Solar Power Plant. d) Report of The Specified Officer: In respect of their application dated 08.02.2024, the specified officer was requested to submit the verification report. The Specified Officer vide his letter dated 18.03.2024, has submitted that, the unit has not procured any type of material i.e. Capital Goods/Consumables after 20.02.2024 till date for installation of rooftop Non-conventional Solar power Plant. e) Specific Issue on which decision of Approval Committee is required: Approval of the Committee for installation of rooftop Non-conventional Solar power Plant, for captive consumption with availing of duty benefits, for captive consumption in terms of Office Memorandum dated 07.03.2024 issued by MOC&I as detailed below: 1 Name of the Vendor of Solar Power Plant M/s. Shree Engineers & Contractors 2 Vendor-Service Setting up of a solar PV project. 3 Capacity 480 KW 4 Annual Generation in capacity 700800 KWH 5 Total Expenditure Rs.1.75Cr. f) Relevant provisions:
- As per MOC&I O.M. issued under F.No.K-43014(16)/8/2020-SEZ dated 07.03.2024, “Duty benefits under Section 26 of SEZ Act, 2005 is allowed to the units for installation as well as O&M of renewable energy equipment exclusively for captive consumption of the unit with a specific condition that the power shall not be wheeled out to DTA.”
- As per MO&I’s O.M. dated 07-06-2021 issued under F. No. K- 43014(16)/8/2020-SEZ, in partial modification of Power guidelines issued vide letter No. P-6/03/2006-SEZ (Vo,.III) dated 16.02.2016, following proviso under para (iii) has been appended :
“Provided that, with the approval of Unit Approval Committee, a Unit may setup a non-conventional power plant within the premises of the Unit for the exclusive purpose of captive consumption subject to the condition that no tax/duty benefits stipulated under Section 26 of SEZ Act, 2005 shall be available for setting up as well as operations and maintenance of such power plant. Such captive generating power plants shall comply with all rules, regulations and technical standards framed under the Electricity Act, 2003 as amended from time to time. Captive generative power plants with capacity 500KW and above has to be re-registered with Central Electricity Authority”. g) Other Information : File No.S-SEZ-PRO0MIDK/4/2022-JDCP
