Ltd. - SEZ Agenda Item No.01: Confirmation of the Minutes of the 27th meeting held on 26.08.2022 After deliberation, the committee approved the minutes of the 27th UAC Meeting held on 26.08.2022 Agenda Item No.02: Application of M/s. SEZ Biotech Services Pvt. Ltd. (Developer) for approval of additional List of Material for authorized operations. The Committee was informed that the jurisdictional Specified Officer has submitted his verification report in which it has been informed that that item shown at Sr. No 1 i.e. “Battery powered reduced scale Electrical Vehicle (Aston Martin) Model DB5 Junior with accessories” does not appears to be Golf Cart and it appears that the said vehicles are luxury 2 seater cars which can ferry only 1 passenger at a time and thus are not essential for authorized operations. The other items i.e. item mentioned in Sr. no 2,3,4, 5 and 6 are essential and required for carrying out authorized operation and hence request of the Developer for approval of items at Sr. No 2,3,4, 5 & 6 totally valued at Rs. 61.14 Crores for carrying out authorized operation may be considered. 2 After deliberation, Committee approved the list of material submitted by the Developer for item Sr. No 2 to 6 (i.e. Lift/Elevator, cement, structural steel, reinforcement steel and post tensioning strand) required for authorized operation purpose totally amounting Rs. 6114.40 Lakhs duly certified by the Chartered Engineer S.G. Purohit in terms of Rule 12(2) of SEZ Rules, 2006.
For the item mentioned in Sr. No 1 i.e. Battery operated Reduced Scale Electric Vehicle (2 nos), the Committee has directed the Developer to provide precedents of similar cases and seek clarification from the Ministry of Commerce and Industry (MoCI). Once the clarification from MoCI is obtained, the Developer should submit a proposal in the subsequent UAC for further consideration. Meeting ended with a vote of thanks to the Chair.

AGENDA NOTE FOR CONSIDERATION OF THE APPROVAL COMMITTEE

a) Proposal: - Application of M/s. SEZ Biotech Services Pvt. Ltd. (SEZ Developer) located at 212/2, Off Soli Poonawalla Group, Hadapsar, Pune-411028 for approval of additional List of Material for authorized operations in the processing area.

b) Specific Issue on which decision of Approval Committee is required: - Approval for import of Battery powered reduced scale Electrical Vehicle (Aston Martin) Mode DB5 Junior with accessories (2 nos) for authorized operations in the Processing area of the SEZ totally valued at Rs.70 lakhs. c) Previous reference : The above proposal of the unit was taken up for consideration in the Approval Committee meeting held on 30.05.2023 wherein the Committee was informed that the jurisdictional Specified Officer has submitted his verification report in which it has been informed that the “Battery powered reduced scale Electrical Vehicle (Aston Martin) Model DB5 Junior with accessories” does not appear to be Golf Cart and it appears that the said vehicles are luxury 2 seater cars which can ferry only 1 passenger at a time and thus are not essential for authorized operations. The Committee directed the Developer to provide precedents of similar cases and further directed that the matter be referred to MOC&I for clarification and once clarification from MoCI is obtained, the proposal should be submitted in the subsequent UAC for further consideration. This office had vide letter dated 14.06.2023 referred the matter to Ministry. The Developer has submitted copy of the Minutes of the Unit Approval Committee Meeting of Noida, SEZ held on 12.09.2011 wherein in the case of M/s Seaview Developers Ltd. the proposal of the Developer for import of ‘Six Seater Yamaha Concierge Electric People Mover’ was approved by the Committee.
It is seen that the Six Seater Yamaha Concierge Electric People Mover is a golf cart. The developer has also submitted a copy of the minutes of the Unit Approval Committee Meeting of Visakhapatnam SEZ held on 10.05.2023. In the case of M/s Tata Consultancy Services, the developer's proposal for the procurement of a 14-seater battery-operated vehicle and a 4-seater battery-operated vehicle was approved by the committee (Ref. Agenda 4 (e)). The committee has also approved the procurement of various types of battery-operated vehicles (Ref. Agenda No 4 (f)). MOC&I vide letter F.No. K-43016(11)/23/2021-SEZ dated 23.06.2023 has informed to take appropriate action in terms of Rule 10 of the SEZ Rules, 2006. As per Rule 10 of the SEZ Rules, 2006 - “The Approval Committee may permit goods and services to carry on the operations authorized under Rule 9”
d) Observation of ADC : The proposal of the Developer for import of Battery powered reduced scale Electrical Vehicle (Aston Martin) Mode DB5 Junior with accessories (2 nos) for authorized operations in the Processing area of the SEZ is placed before the Approval Committee for consideration in terms of Rule 10 of SEZ Rules, 2006. ----------------------------------------- File No.S-SEZ-PRO0SBSP/3/2022-JDCP I/2243/2023 169
