No.:S/5-Gen-85/2009-10 CCSP Cell DIN: 20220678NU0000666C82 Public Notice No. 26/2022 Ocean Gate Container Terminal Private Limited was appointed as Custodian vide Notification No. 23/2010 dated 28.05.2010 for the CFS at Palaspe, Near Bharat Petroleum Fuel Station, Panvel-Goa Highway, Tal Panvel, and Dist-Raigad-4 10221 (declared as Customs Area Vide Notification No. 22 /2010 dated 28.05.2010). Further vide Notification No. 01/2012 dated 11.01.2012 for five (05) years and vide Notification No. 07/2017 dated 05.06.2017 Ocean Gate Container Terminal Private Limited in respect of its Notified area 74,660 SQM, has been appointed as Custodian and Customs Cargo Service Provider for further five (05) years. 2. Now, in exercise of the powers conferred on me under Section 45(1) and 141 (2) of the Customs Act, 1962, 1, Istikhar Baig, Commissioner of Customs, General, Mumbai Zone- I, Nhava Sheva hereby renew the appointment of Ocean Gate Container Terminal Private Limited to be the Custodian' of the Imported goods received at the Container Freight Station of Ocean Gate Container Terminal Private Limited until these are cleared for home consumption or are warehoused or are transhipped in accordance with the provisions of Chapter VIlI of the Customs Act, 1962 for the entire Customs Area of 74,660 sQM. Similarly, Ocean Gate Container Terminal Private Limited will also be the 'Custodian' of the Export cargo brought into said Container Freight Station for examination and stuffing till their exportation through Jawaharlal Nehru Port. 3. Further, in exercise of the powers conferred on me under Regulation 10 of the "Handling of Cargo in Customs Areas Regulations, 2009", 1, Istikhar Baig, Commissioner of Customs, General, JNCH hereby rernew the approval of Ocean Gate Container Terminal Private Limited as a "Customs Cargo Services Provider" for the above mentioned Container Freight Station subject to the following conditions G) The Custodian Ocean Gate Container Terminal Private Limited approved as "Customs Cargo Services Provider" for the said CPS shall abide by all the provisions of the Customs Act, 1962 and the rules under the "Handling of Cargo in Customs Areas Regulations, 2009" and other regulations, notifications, orders issued there under. ii) The duration of appointment of Ocean Gate Container Terminal Private Limited as Custodian' and as the 'Customs Cargo Service Provider shall

remain valid for a period of ten (101 year from 05.06.2022 provided the validity of the AEO-LO status of the CFS extended. If the validity of AEO status granted to the CFS is withdrawn prior to the 09.01.2023 or is not extended beyond 09.01.2023 the validity shall be valid for a period of five (051 year from 05.06.2022 instead of ten (10] year. ii) The waiver from execution of Bank Guarantee has been given in terms of regulation 5(3) of HCCAR, 2009 as the CFS has been accredited with AEO- LO status with validity till 09.01.2023. If the validity of ADO status granted to the CFS is withdrawn prior to the 09.01.2023 or is not extended beyond 09.01.2023, the CFS shall execute bank guarantee for the amount, as determined, w.e.f. date of expiry of validity of AEO status. (iv) The Commissioner of Customs (General), JNCH shall have the Right to review the approval as Customs Cargo Services Provider' before the completion of ten year for failure to comply with any of the Regulations of the "Handling of Cargo in Customs Areas Regulations, 2009 or as per the directions of the Government of India.
