PUBLIC NOTICE NO. 95/2017

Attention of all the importers, exporters, Customs Brokers and the member of the Trade are invited to Public Notice No 12/2010, dated 09.02.2010 (Standing Order No. 09/2010, dated 09.02.2010) issued by JNCH and the Notification No. 35/2017-Cus (NT), dated 11.04.2017 regarding amendment of Bill of Entry under Section 149 of Customs Act, 1962. Earlier, Additional/Joint Commissioner of Customs was assigned the function under Section 149 of the Customs Act, 1962 as the proper officer vide Notification No. 40/2012-Cus (N.T.) dated 02.05.2012. Now, the Board vide above Notification No. 35/2017-Cus (NT) dated 11.04.2017has amended the said Notification No. 40/2012-Cus (N.T.) dated 02.05.2012, and;

(i) The Deputy/ Assistant Commissioner of Customs (DC/AC), has now been assigned the function under Section 149 of the Customs Act, 1962 as the proper officer (after grant of order for clearance of goods under section 47 or section 51) of the Customs Act, 1962, as the case may be. (ii) The Superintendent of Customs and Central Excise or Appraiser has now been assigned the function under Section 149 of the Customs Act, 1962 as the proper officer (before grant of order for clearance of goods under section 47 or section 51) of the Customs Act, 1962, as the case may be.

In view of the above, the officers are directed to follow the above mentioned Notification No. 40/2012-Cus (N.T.) dated 02.05.2012 as amended by Notification No. 35/2017-Cus (NT), dated 11.04.2017to carry out the amendment under Section 149 of the Customs Act, 1962.

Difficulties, if any, face in the implementation of these instructions may be brought to the notice of the Deputy/Assistant Commissioner in charge of Appraising Main(Import) through email/phone(email address:appraisingmain.jnch@gov.in / Phone No.022-27244779)

Action to be taken in terms of decisions taken in this Public Notice should beconsidered as standing order for the purpose of officers and staff.
