Attention is invited to Standing Order No.16/2020 dt. 16.06.2020 prescribing the Standard Operating Procedures to deal with various cases/tasks in EDI Section of JNCH, Mumbai Zone-II. Sl. No. 2 of SOP deals with Cancellation of Out of Charge of Bill of Entry in the system by the AO(EDI) after approval of ADC/JC of concerned group and DC/EDT in file.

de Further, this Standing Order No.16/2020 dt. 16.06.2020 was amended vide Standing Order No.19/2020 dt. 29.07.2020 in view of issuance of Notification No.40/2012-Customs (NT) dt.02.05.2012 as amended by Notification No.12/2014-customs (NT) dt. 17.02.2014 and 35/2017-Customs (NT) dt.11.04.2017 vide which AC/DC has been designated as proper officer under Section 149 of the Customs Act 1962 for cancellation of Out of Charge.

3. The Trade have brought to the notice of the Department that the procedure followed in EDI Section is merely leading to additional time consumption. Accordingly, the following Standard Operating Procedure is issued in suppression of the above SI. No.2 of the SOP issued vide Standing Order No.16/2020 dt. 16.06.2020 as amended vide Standing Order No.19/2020 dt. 29.07.2020.

“In case of amendment under Section 149 of the Customs Act 1962, the concerned group AC/DC after approval in file will cancel the OOC of the BE in the system with suitable comments and recall the BEfor necessary amendment. The necessary role is being assigned by the ADC/JC(EDI) to all the group AC/DCfor this purpose”.
