NOTIFICATION NO. 30 (RE-2003)/ 2002-2007 NEW DELHI DATED THE 28th JANUARY, 2004

S.O. (E) In exercise of powers conferred by Section 5 of the Foreign Trade (Development & Regulation) Act, 1992 (No.22 of 1992) read with Paragraph 1.1, 2.1 2.4 and 2.29 of the Export and Import Policy, 2002-2007, the Central Government hereby makes the following amendments in the ITC(HS) Classification of Export and Import Items, 2002-2007 as amended vide Notification No.3 (RE-2003)/2002-2007 dated 31st March, 2003 and as amended from time to time:-

2.         Against item code numbers 3102, 3103 , 3104 and 3105 under Heading   “ Fertilizers” in  Schedule 2 of ITC(HS) , the following amendments
   

shall be made:-

Manufacturers of SSP, as listed at Appendix 5 ( A ) to Schedule 2 of ITC(HS) , shall be allowed to export freely their own manufactured SSP subject to the following conditions :-

Intimation to Department of Fertilizer

Production of above declaration / certificate as at (i) above to Customs at the time of export.

3104 Straight Potassic Fertilizers given below:

Potassium Chloride
( Muriate of Potash ) (All grades ) Restricted Export permitted under licence , except in following case:-

(a) Exports permitted freely by direct importers of MOP out of quantity of import made during last six months subject to the following conditions :-

(i) They will not claim any concession for the quantity intended to be exported ; or

(ii) they will be return the concession if already claimed from the Government; and

furnish certificate from the statutory auditors to the Department of Fertilisers

export realisation in free foreign exchange only. 3105 ( A ) N.P. Complex Fertilizers given below :

Diammonium Phosphate (DAP) ( 18- 46-00) Restricted Export permitted under licence except in following case:-.

Manufacturers of DAP , as listed in Appendix 5 ( B ) to Schedule 2 of ITC(HS) , shall be allowed to export freely their own manufactured DAP subject to the following conditions:-

Intimation to Department of Fertilizer about quantity of export along with a self-declaration and a certificate issued by statutory auditors that no concession/subsidy has been claimed for intended export.

ii) Production of above declarations / certificates as at (i) above to Customs at the time of export.

3105 NP ( 16-20-0) NP ( 20-20-0) NP ( 28-28-0) NP ( 23-23-0)

and

( C ) N.P.K. Complex Fertilisers given below :- Nitrophosphate with Potash ( 15-15- 15) N.P.K (10-26-26) N.P.K.( 12-32-16) N.P.K.( 14-35-14) N.P.K.( 14-28-14) N.P.K.( 19-19-19) N.P.K.( 17-17-17) viii) N.P.K.( 15-15-15)

Restricted except in following cases:-.

Manufacturers of NP and NPK , as listed at Appendix 5 ( C ) of Schedule 2 of ITC(HS) , shall be allowed to export freely their own manufactured NP / NPK subject to the following conditions:-

Intimation to Department of Fertilizer about quantity of export along with a self-declaration and a certificate issued by statutory auditors that no concession/ subsidy has been claimed for intended export.

ii) Production of above declaration / certificate as at (i) above to Customs at the time of export.

3102 3103 3105 All chemical fertilisers fortified with zinc or boron Restricted Export permitted under licence. 3105 Micronutrient fertilisers and mixtures thereof containing NPK , excluding those specified in Schedule 1 Part A 1 (f) of Fertilisers Control Order , 1985 Restricted Export permitted under licence.

3.         The list of manufacturers of NP / NPK Fertilisers which will form Appendix 5 (C ) of Schedule 2 of ITC(HS) is annexed.
