Decision: Mr. Mahesh, Managing Director attended Personal Hearing on behalf of the firm. He was explained in detail as to what information, the firm was required to submit for revision of norms. The information submitted by the firm and the actual information required by Department of Chemical & Petrochemical for revision of norms was explained to him. He was also advised that the firm should explain in detail the process of manufacturing stage – wise and this should be supplemented by Actual Data of consumption duly certified by CA for the period 2010-11 and 2011-12. After giving this comprehensive Note, the firm was advised to submit details of all the Advance Authorizations individually.

Decision: Mr. Mahesh, Managing Director attended Personal Hearing on behalf of the firm. He was explained in detail as to what information, the firm was required to submit for revision of norms. The information submitted by the firm and the actual information required by Department of Chemical & Petrochemical for revision of norms was explained to him. He was also advised that the firm should explain in detail the process of manufacturing stage – wise and this should be supplemented by Actual Data of

PRO version consumption duly certified by CA for the period 2010-11 and 2011-12. After giving this comprehensive Note, the firm was advised to submit details of all the Advance Authorizations individually.

  1.     Representative of firm during Personal Hearing drew attention of Committee that in one Advance Authorization No.

0410122928 dated 25.03.2011, there is an apparent mistake in respect of quantity allowed for Import Item No. 4, that is, H60 Foam Blank against Export Product No. 4, that is, PVC Rigid Block 2440 x 1220 x 76 MM. In this item, against the export of 1656 Nos., the import of 1338 Nos. has been allowed. He further stated that the export item is in Nos. can’t be less than the import item Nos.

  1.     Representative of D/o C&PC also agreed with the view of Representative of firm informing that there is an apparent mistake

in respect of this item norms. He further stated that in other similar cases of the same firm, the items in respect of this item vide their comments No. 46011/61/2009-PC.II dated 05.08.2011 against export of 1747 Nos., import of 1834 Nos. has been allowed, which works out to 1.05 Nos. Similarly vide their comments No. 46011/61/2009-PC.II dated 30.08.2012, they have allowed 2752 Nos. against export of 2621 Nos. There again the ratio works out to be 1:1.05.

  1.     In view of the observations of Representative of D/o C&PC and in view of the earlier comments of D/o C&PC No.

46011/61/2009-PC.II dated 05.08.2011 in similar cases quoted above, the Committee decided to change the quantity of Import Item No. 4 from 1338 Nos. allowed earlier to 1739 Nos. against Export Item No. 4 in respect of Advance Authorization No. 0410122928 dated 25.03.2011

  1.     Accordingly, the norms in respect of Export Item No. 4 against Advance Authorization No. 0410122928 dated 25.03.2011
