Decision: The Committee discussed the case with the Technical Representative of DIPP and decided to amend the Note of the case approved in Norms Committee Meeting No. 30/AM12 held on 25.10.2011 to read as under:

“The Import Item is covered under ITC HS Code 40040000 which defined as ‘waste, pairings and scrap of rubber (other than hard rubber) and powders and granules obtained therefrom. According to the ITCHS Code scrap of rubber is a restricted item under import policy subject to condition that import of used rubber tyres with one cut in bead wire and import of used rubber tubes cut in two pieces, however, is free. The firm has not mentioned cut(s) in rubber tyres. Keeping in view the above policy provision, the Committee decided that Used Rubber Tyres (Cut/Shreds) imported under Advance Authorization must have one cut or more than one cut in bead wire.”

PVC Flooring Scrap (Pre Consumer Industrial Scrap) 222600 kg Note: The import of PVC Flooring Scrap (pre consumer industrial scrap) will be governed by conditions laid down in Notification No. 24 (RE-2006)/2004-2009 dated 26.07.2006 and minor amendment vide Notification No. 54 (RE-2008)/2004-2009 dated 05.11.2008. The imported PVC Flooring Scrap (pre consumer industrial scrap) will be used only for the manufacture of Three Layered Printed PVC Flooring Covering.

            PVC flooring scrap (scrap denotes industrial trimmings and rejects only) with the

following specifications shall be permitted for imports:

(i) The PVC Flooring Scrap shall consist of thoroughly blended composition of thermoplastic binder, fillers and pigments. The thermoplastic binder shall consist substantially of one or both of the following namely (a) Vinyl Chloride polymer and (b) Vinyl Chloride co-polymer. (ii) The density shall be > 1.3. (iii) Ash content shall be <21 to 30% . (iv) The product manufactured form scrap shall conform to IS 14535: 1998-Recycled plastics manufacture of products – design, and (v) Recycling shall be in accordance with IS 14534: 1998-Guidelines for recycling of plastic. (vi) Final Waste PVC scrap (i.e. unconverted to floor coverings etc.) shall not exceed 5% of the quantity imported and shall be disposed of in landfills.

 All imports shall also be subject to the following conditions:

(i) Only industrial, trimmings and rejects of PVC flooring scrap shall be allowed to be imported. (ii) Post consumer PVC flooring scrap and waste shall not be allowed to be imported. (iii) Imports shall only be allowedto actual users.

PRO version ( ) po ts s a o y be a owedto actua use s. (iv) The concerned Pollution Control Boards/Pollution Control Committees shall monitor the use of PVC scrap imported by the units. (v) The units/PVC scrap users shall file a return of imports made during a calendar year to concerned PCB/PCCs; and (vi) The product so manufactured should meet the BIS specifications IS 3462, 1986 for unbacked flexible PVC floorings.

Decision: The Committee discussed the case in light of Deficiency letter issued by D/o C&PC vide D/L No.

PRO version 46011/87/2011-PC.II dated 03.10.2011 to firm, followed by repeated reminders from DGFT on 21.02.2011 and 15.11.2011 giving 15 days time to firm for submission of information. The Committee observed that the firm failed to furnish information despite repeated reminders. Hence, the Committee was unable to fix adhoc norms for want of information from firm and accordingly rejected the case. RLA will take further necessary action in this case.
