Request: Fixation of adhoc norms for the export product “Plunger with Handle in various sizes”.
Decision: The case of M/s Gala Brush Ltd., Mumbai was considered only for the closure of the subject advance licence. Shri Vijay Kori, Import & Export Manager attended the Personal Hearing and submitted the information as asked for from the firm. The case was discussed in detail and it was decided by the Committee to ask firm to furnish following information within 15 days as asked for by DIPP:
(a) A copy of Shipping Bill clearly indicating the total weight of Chloroprene Rubber exported;
(b) Chartered Accountant Certificate indicating the total consumption of Chloroprene Rubber alongwith
all other indigenous / imported raw material;
(c) The wastage at each stage of manufacture; and
(d) Individual weight of each of the two type of the Plunger alongwith their total number already
exported. The percentage of Chloroprene Rubber / weight of Chloroprene Rubber in each of the type of the export product may also be indicated.
Deferred for two weeks.

Request: Amendment in the description of Export Product.
Decision: The Committee considered the case only for the closure of the advance licence. The Applicant has stated that while making application they mentioned the description of Export Product as “Polyacrylic Based Compounded Rubber (Unvulcanised) in Sheets Form IHS85”. However, while fixing the norms, ALC in its Meeting No. 35/AM06 held on 14.12.2005 decided to amend the description of Export Product to read as “Polyacrylic based Compounded Rubber Reinforced with glass fibre and graphite containing net 50.8% Polyacrylic Rubber (unvulcanised in sheets forms IHS85)”. Subsequently, NC again in its Meeting No. 32/AM07 held on 22.11.2006 amended the description of Export Product to read as “Polyacrylic based Compounded Rubber Reinforced with glass fibre and graphite containing net 50.8% Polyacrylic Rubber (unvulcanised) in sheets forms”. The firm has informed that before the decision of NC communicated to them, they had almost completed the exports and in Shipping Bills they had indicated description as applied for by them (in 4.7 application), that is, “Polyacrylic Based Compounded Rubber (Unvulcanised) in Sheets Form IHS85”.

The Committee considered the detail and decided that since the licence has already expired, hence no amendment can be
carried out on an expired licence. However since Applicant has stated that they have made exports before NC’s decision and indicated the description of export product in Shipping Bills as applied for, that is, “Polyacrylic Based Compounded Rubber (Unvulcanised) in Sheets Form IHS85” . RA, Chennai may examine the case only for the closure purpose based on following parameters:
(a) It may be verified that substantial exports had been completed before NC’s decision was communicated to the firm and in Shipping Bills they had indicated description as applied for while making application.

(b) Poly Acrylic Rubber has to be accounted for in the export product as mentioned by NC, since this is not mentioned in Shipping Bills as firm has stated that firm has made exports prior to decision of NC, firm may be asked to give other relevant documents duly certified by Chartered Accountant alongwith statement signed by firm as well as Chartered Accountant which duly accounts for Poly Acrylic Rubber.
(c) Applicant may be asked to give affidavit also that in case at any point of time the information furnished by them is found incorrect they would pay customs duty alongwith applicable interest.
