The committee noted that in the copy of License submitted in the review application of the firm, the export item is “Ready to Eat Processed Foods and Vegetables (i.e., Naan, Paratha, Samosa, Uttapam idli, etc”. However, there is no bifurcation of the quantity of each import item to be used in the different export items. Therefore, the committee decided to ask the firm to submit a statement showing the Quantity of Import item used in each Export item.

The firm based on the NC decision had agreed to the IO norms fixed prior to the issue of the Advance Authorisation and subsequently got the AA issued and completed the import and export cycle.

Now, at a later date the firm is seeking a lower yield percentage and has requested to apply IO norms notified for SION E 125 for the export item Cocoa Butter Equivalent (CBE) which is a combination of 50% Shea Stearine and 50% PMF.
NC noted that SION E-125 was notified in 2006 in which the recoverable wastage was also deducted while arriving at the import entitlement of Shea Nuts. Further NC also noted that firm had also made a request for revision of SION E 125 and submitted production-consumption data to substantiate higher IO norms. MoFPI had set up an internal committee to examine this issue and in September 2022 had recommended a upward revision in E 125. MoFPI had also observed that the price of Shea Nuts and its byproducts are dynamic in nature in short as well as medium term as such the IO norms needs to be reviewed at regular intervals.
NC also noted that besides M/s Manorama Industries Limited, there is another major exporter, i.e. M/s 3F Industries who is a largest exporter in this EXIM business and accordingly inputs/data from M/s 3F Industries was also requested. 9 any change/enhancement in SION E-125. The Committee did not modify SION E-125 for a higher entitlement based on data submitted by a single exporter, i.e. Manorama Industries.

NC also observed that inconsistent production-consumption data, recoverable wastage and its sale price has been submitted by the firm in their different applications leading to a situation where IO norms in 2020 and 2022 have wide variations and need further examination and reconciliation so as to arrive at correct import entitlements after deducting the sale value of recoverable by-products. The Committee also noted the non- cooperation of M/S 3F Industries in providing production-consumption data for carrying out revisions in existing IO norms for export of Shea Stearine from duty free imports of Shea Nuts based on present import/export values and sale price of by-products.
NC also drew the attention of the exporters to legal provisions of Para 4.06 (iii) and (v) of the HBP 2023 and requested compliance of the exporting firms.
After extensive deliberations in the matter, NC was therefore of the opinion that to arrive at a correct assessment of SION E 125 we will need revised data from the 2 major exporters i.e. M/S Manorama Industries and M/S 3 F Industries and other interested exporting firms.

NC therefore decided the following: a) NC decided to recommend to DGFT for suspending SION E 125 fixed in 2006 as inconsistencies in recently submitted data in 2020 and 2022 need further verification; b) NC decided to call for applications in ANF 4B along with supporting documents for re-assessing IO norms in E 125. c) The present application for Review will be decided after re-visiting the SION E 125 based on revised production-consumption data of related import and export items, sale value of by-products along with their sample GST certified invoices and copies of Shipping Bills and Bills of Entry.

After extensive deliberations in the matter, NC was therefore of the opinion that to arrive at a correct assessment of SION E 125 we will need revised data from the 2 major exporters i.e. M/S Manorama Industries and M/S 3 F Industries and other interested exporting firms.
