The Committee considered the case as per agenda and noted that for certain export items, the Foreign Trade Policy under Para 4.11 does not allow the exporter the facility to import duty free inputs for export production on self- declaration basis. Responsibility of prior fixation of Input Output Norms for such export items has been mandated and assigned to the Norms Committee. B. In the present case, the Committee is examining the determination of IO norms for export of poppy seed oil through use of imported poppy seeds. The NC 6 Secretariat informed that in the past 4 years or so, no case of issue of Advance Authorisation for duty free import of poppy seeds for export production has come to the Committee for fixation of IO norms, which indicates that this is not a usual business and export activity. The Committee noted that the applicant exporter has no past experience in this field and the firm has not registered & submitted any import contracts, present or previous, with the Narcotics Commissioner which is a mandatory requirement prior to import as per Department of Revenue guidelines. A personal hearing was also extended to the firm on 17.11.2022 in which the representative informed that they are in the process of finalisation of import/export contracts with international sellers of poppy seed and buyers of poppy seed oil.

Committee also noted that for implementation of National Policy on Narcotic Drugs and Psychotropic Substances, restrictions like fixing of country caps on imports, imposing quantity restrictions per importer etc. or other conditions can be imposed on the import contracts by the Narcotics Commissioner. The input item i.e. Poppy Seed has certain import restrictions in place and the Import Policy condition for HS code 12079100 reads as “Import of Poppy Seeds (Exim Code 12079100) shall be allowed subject to the following conditions: a) Import permitted only from Australia, Austria, France, China, Hungary, the Netherlands, Poland, Slovakia, Spain, Turkey and Czech Republic, United Kingdom, Democratic Peoples Republic of Korea, Macedonia, Germany and Ukraine; b) The importer shall produce an appropriate certificate from the competent authority of the exporting country that Opium Poppy have been grown legally in that country;

6 (b) 100 Kg Poppy Seeds would results in to (i) 28Kg Poppy Seeds oil (cold press); (ii)69 Kg of Semi-oiled cake (with 15% oil content) after allowing for 3% processing losses. The value of the by-products may be obtained from applicant company and factored in by DGFT while fixing ad- hoc IO norms. E. The Committee in its meeting dated 17.11.2022 had also referred the matter to Central Bureau of Narcotics for a ‘No Objection Certificate’ before the Committee can go into the technical determination of IO norms. CBN in their response dated 22 December 2022 have stated that the import of poppy seeds by M/S Crown Impex, Moradabad shall be done in terms of guidelines issued by Department of Revenue at the time of actual importation by the firm. CBN also mentioned that the issuance of Advance Authroisation to a firm and fixation of norms for that is subject matter of DGFT, New Delhi and this office has no role with this regard. If there is any provision requiring NOC from CBN for issuance of NOC for fixation of norms for advance authorization, the same may please be submitted to this office for further action. F. Based on the inputs received from Policy 4 Division, Narcotics Commissioner, the technical representative i.e.

G. Committee also noted a Policy paper dated November 2019 of the US Drug Enforcement Administration (Diversion Control Division) on unwashed Poppy Seed available on the internet. Some extracts of the paper are as under: i) Poppy seeds are a naturally derived product originating from a flowering plant known as papaversomniferum (poppy plant). Depending on the methods of harvesting and geographical origin of the plant, unwashed poppy seeds may have higher amounts of Schedule II opium alkaloids such as morphine, codeine, and thebaine on their seed coats when compared to washed poppy seeds. The poppy seeds themselves possess no opium content. Instead, the opium alkaloids (e.g., morphine, codeine, and thebaine) are found in the poppy latex, which is a milky white fluid that exudes from the pod when it is cut.

Harvesters, who wish to increase opium alkaloids contents on the poppy seed coats, make cuts in the opium pods before they ripen which allows the latex to seep onto the seed coats. Individuals wishing to extract the opium alkaloid content from unwashed poppy seeds, use the seeds to create a tea, which contains sufficient amounts of alkaloids to produce psychoactive effects. ii) The surface of unwashed seed is typically contaminated with the same opium alkaloids (e.g., morphine, codeine and thebaine), as found in the latex exudate from the poppy pods. The opium alkaloids such as morphine and codeine bind to and act as agonists at opioid receptors thereby producing psychoactive and other pharmacological effects iii) Unwashed poppy seeds are abused for their opioid effects. Some users boil the seeds to produce a tea, which is consumed for the purposes of perceived “natural” pain relief. Others produce the poppy seed tea from unwashed poppy seeds purely to obtain a “high”. 7 seed material, are not exempted from CSA control. Encounters of these materials are in violation of the Controlled Substances Act. H. i) The Committee, deliberated the issue in detail and noted that certain import conditions on the input item ‘poppy seed’ are in place in the ITCHS Import Policy on account of its possible dual use in the ‘narcotics’ area. Elaborate restrictions and import registration requirements as per Department of Revenue guidelines are also in place and are being implemented by the Central Bureau of Narcotics to monitor its end use. The possibility to extract the opium alkaloid content from unwashed poppy seeds, which contains sufficient amounts of alkaloids to produce psychoactive effects has also been deliberated in para G above. ii) The Committee, noted that the applicant exporter at the time of making this Advance Authorisation application and till date, has no permission from CBN, Gwalior for allowing imports and is only citing the inclination of the firm to abide by the Import Policy conditions at the time of making import. The Committee also noted that this is the first application of import of poppy seed for production of poppy seed oil and its subsequent export under the Advance Authorisation Scheme and no earlier application or precedence is available to rely upon.

The Committee also noted that the firm has not been in the business of production of ‘poppy seed oil’ before and are ‘new-comers’ and do not have permissions from Central Bureau of Narcotics poppy seed cultivation and its processing. The Committee also noted that the MoFPI, who provide technical support for IO determination, have indicated that the business model of the firm indicates a much lesser yield of the end product i.e. poppy seed oil (28%), as against the available knowledge and literature, and also leaving a higher than usual oil- rich poppy meal cake, a by-product, containing more than 15% oil after oil extraction from poppy seed. The commercial value and use of this oil rich cake, which is a by-product, is not readily ascertainable and is not backed by industry evidence. iii) The Committee also noted that the export potential of the export item i.e. poppy seed oil may be very limited and possibly needs no encouragement under duty free regime of a FTP scheme. The Committee, therefore, as discussed above and considering the business model of a ‘new-comer’ which has possible ‘dual use’ as a controlled substance at the input stage decided not to support the Advance Authorisation model. The Committee therefore does not allow import of duty free inputs i.e.
