The Jawaharlal Nehru Customs House (JNCH), vide Public Notice No 87/2023-24 dated 05-10-2023 had approved the Additional Liquid Cargo Jetty duly constructed by Jawaharlal Nehru Port Authority (JNPA) with a capacity of 4.5 MTPA to handle the liquid vessels under Section 8(a) of the Customs Act 1962. The Berth consisted of unloading platform of size 108m 50m, mooring dolphins 4 nos and pump house 49m20m at Jawaharlal Nehru Port, Village NhavaSheva, Taluka Uran, Dist. Raigad Maharashtra.

2. The JNCH Public Notice No. 15/2024 dated 23-04-2024 has also approved Jawaharlal Nehru Port Authority as Custodian of the import cargo unloaded at the Additional Liquid Cargo Berths LBO3 and LBO4 and Customs Cargo Service Provider for the Additional Liquid Cargo Berths LBO3 and LBO4.

3. The JNCH vide letter No S/5-Gen-07/2023-24/CCSP CELL/JNCH dated 26-02-2024, has granted permission to JNPA for commencement of operation in the Additional Liquid Cargo Berths LBO3 and LBO4.The Jawaharlal Nehru Port Authority (JNPA) has issued the letter of Intent (LOI) for the work of “Equipping, Operation, Maintenance and Transfer of Additional Liquid Cargo Berths LBO3 and LBO4 at JN Port through Public Private Partnership (PPP) mode on 19** February 2024 to M/s JSW

Subsequently, JSW Infrastructure Limited have formed a Special purpose vehicle (SPV) by the name of M/s JSW JNPT Liquid Terminal Private Limited (JJLTPL), which will be the Concessionaire for the project of “Equipping, Operation, Maintenance and Transfer of Additional Liquid Cargo Berths LBO3 and LBO4 at JN Port through Public Private Partnership (PPP) mode”. The Concession Agreement was signed on gth April 2024 by JNPA with M/s JSW JNPT Liquid Terminal Private Limited (JJULTPL). As per the Concession Agreement, the Concessionaire JJLTPL will assume the custodianship of the Additional Liquid Cargo Berths LBO3 and LBO4 as the same will be handed over by the JNPA on the date of award of concession.

Ss. The JNPA has awarded the Concession to M/s JSW JNPT Liquid Terminal Private Limited (JJLTPL) on 22™¢ August 2024. The map/drawing of the Jawaharlal Nehru Port Additional Liquid Cargo Berths LBO3 and LBO4 facility including the coordinates of back up area which has been handed over to M/s JSW JNPT Liquid Terminal Private Limited, are already mentioned in Public Notice No. 87/2023-24 dated 05-102023. 6. Further, M/s JSW JNPT Liquid Terminal Private Limited (JJLTPL) as per agreement has to carry out Liquid Cargo Terminal operations of the Additional Liquid Cargo Berths LBO3 and LBO4 premises after obtaining permission as CCSP.

7. Now, in exercise of the powers conferred on me under Section 45(1) and 141 (2) of the Customs Act, 1962, I, D.S. Garbyal, Commissioner of Customs (General), JNCH, Mumbai Zone-II, Nhava Sheva hereby appoint

M/s JSW JNPT Liquid Terminal Private Limited (JJLTPL) to be the Custodian of the imported cargo received at the Additional Liquid Cargo Berths LBO3 and LBO4 located inside the Jawaharlal Nehru Port, TalukaUran, Dist: Raigad, Maharashtra until these cargoes are delivered to the Tank farms in accordance with the provision of Chapter VIII of the Customs Act, 1962.

8. Further, in exercise of the powers conferred on me, I, D.S. Garbyal, Commissioner of Customs (General), JNCH, Mumbai Zone-II, Nhava Sheva hereby appoint M/s JSW JNPT Liquid Terminal Private Limited as a "Customs Cargo Service Provider’ for handling of imported cargo received atthe Additional Liquid Cargo Berths LBO3 and LBO4 at Jawaharlal Nehru Port subject to the following conditions:-

(i). The Custodian M/s JSW JNPT Liquid Terminal Private Limited (JJLTPL) approved as Customs Cargo Service Provider for the said Liquid Cargo Berths LBO3 and LBO4 and shall abide by all the provisions of the Customs Act, 1962 and the rules of Handling of Cargo in Customs Areas Regulations, 2009, other Regulations, Notifications, Orders issued there under.

(ii). The duration of the appointment of M/s JSW JNPT Liquid Terminal Private Limited as "Custodian" and "Customs Cargo Service Provider" shall remain fortwo (02) yearsfrom the date of issuance of this notification.

(iii). The Commissioner of Customs (General), JNCH shall have the right to review the approval as "Customs Cargo Service Provider" before the completion of two years for failure to comply with any of the Regulations of the "Handling of Cargo in Customs Areas Regulations, 2009" or as per the directions of the Government of India.

(iv). M/s JSW JNPT Liquid Terminal Private Limited will submit afresh

the copy of NOC from Fire, MPCB after transfer of name in favour of M/s JSW JNPT Liquid Terminal Private Limited (JJLTPL) within six months. At present the Fire, MPCB consent is in the name of JNPA and the MPCB Consent is yet to be amended in the name of M/s JSW JNPT Liquid Terminal Private Limited (JJLTPL) by MPCB.
