MEETING NO. 02/85 DATED 17.06.2021

Please Note

  • (i) For information of exporters, Norms Committee-VI handles all cases pertaining to fixation/ratification of norms for Export Products falling under ITC(HS) Chapter | to 26 & 94-98. Communications in respect of cases pertaining to NC-VI may be sent to email address: p.sahu@gov.in

  • (ii) In certain cases the decision of the Norms Committee refers to the recommendations/ observations/ deficiencies received from the concerned Technical Authority. | Wherever applicable, a scanned copy of such document has been placed at the end of the Minutes, in running serial orders. The concerned firm/company may go through the same and respond accordingly.

  • (iii) | Similarly, a scanned copy of the blank Standard Deficiency Format, which may find a reference in NC decisions, has also been attached in the end. This may also be referred to by the concerned firm/company and may be responded accordingly.

  • (iv) For information of the exporters, it is informed that wherever DL is issued, the case would be rejected in case the reply of the firm is not received within 90 days from the date of issue of DL.

  • (v) The Norms Committee has taken decision only with respect to technical aspect/wastage norms. While redeeming the applications, RAs should check that the applicant has fulfilled all requirements as prescribed in policy/procedure including those in Policy Circulars issued from time to time or any other provisions under FTP/HBP for issuance of AA and regularization of the case.

The Meeting No.02/85 dated 17.06.2021 of Norms Committee-VI for the year 2020-21 for Manual Cases was held on 17.06.2021 under the Chairmanship of Shri Anil Aggarwal, Addl. Director General of Foreign Trade to consider the following applications for ratification of norms in respect of advance authorizations under Duty Exemption Scheme (Chapter-4) of Foreign Trade Policy 2015-2020. Decision: NC considered the case as per agenda and decided to fix the norms of the subject AA on the basis of the comments furnished by Technical Authority, i.e., MoFPI vide OM No.14011/7/2020-ED dated 21.05.2021 followed by subsequent clarification dated 29.06.2021, allowing the following inputs after adjusting the domestic sale value of by-product i.e., Invert Sugar;

Decision: NC considered the case as per agenda and noted that copy of the Shipping Bills furnished by the firm indicates the export of flavours e.g., lemon, chai, peech, pear, cherry etc. The firm vide email dated 9" November, 2020 has furnished a statement in which it has been stated that they have imported 97 Kg of flavour and exported 72.015Kg with the export product. The Committee with due deliberation and on the basis of the comments furnished by the Technical Authority, i.e., Tech.2 decided to modify the decision conveyed vide minutes of M.No.11/85 dated 12.09.2019 and allow import of flavours to the extent as mentioned in the shipping bills against the above mentioned AA.

RA may take subsequent consequential action accordingly.

Ltd. for enhancement of export of Vegetable Fatbase Powder (Containing 23% to 25% Palm Fat), Vegetable Fatbase Powder (Containing 27% to 29% Palm Fat), Vegetable Fatbase Powder (Containing 34% to 36% Palm Fat) and Vegetable Fatbase Powder (Containing 19% to 21% Palm Fat) against import of Refined Bleached and Deodorrized Palmolein (RBD Palmolein), Acid Casein, etc. Decision: NC considered the case as per agenda and noted that ad-hoc norms under Para 4.06 of HBP on the above mentioned application of the firm was fixed in M.No. 08/85 dated 03.12.2020 on the basis of the comments of the Technical Authority, i.e., MoFPI furnished vide OM No. 4(18)/2014-DGFT dated 17.09.2020 and import/ quantity restricted to 500 MT. Further the import quantity has been enhanced by another 500 MT in M.No. 10/85 dated 18.02.2021 with condition that the firm may approach for further enhancement after completion of 50% of export. The Committee with due deliberation acceded to the proposal for further enhancement of 1000 MT of import quantity of RBD Palmolein. Accordingly, the export/import items as approved by the Committee are given below;

This is the 2" enhancement of import items i.e., RBD Palmolein and Acid Casein. With this, the total import of RBD Palmolein permitted so far is 2000 MT and Acid Casein 60 MT.

Other terms and conditions mentioned in minutes of M.No.08/85 dated 03.12.2020 against the above mentioned case will remain same.

Decision: NC considered the case as per agenda and noted that ad-hoc norms under Para 4.06 of HBP on the above mentioned application of the firm was fixed in M.No. 08/85 dated 03.12.2020 on the basis of the comments of the Technical Authority, i.e., MoFPI furnished vide OM No. 4(18)/2014-DGFT dated 17.09.2020 and import quantity restricted to S00 MT. Further the import quantity has been enhanced by another 500 MT in M.No. 10/85 dated 18.02.2021 with condition that the firm may approach for further enhancement after completion of 50% of export. Decision: NC considered the case as per agenda and decided to fix the adhoc norms. under Para 4.06 of HBP, 2015-20 on the basis of the comments furnished by the Technical Authority, i.e., MoFPI vide their OM No. 4(18)/2014-DGFT dated 11.05.2021 allowing the following inputs;

As mentioned above, the total import quantity of RBD Palmolein has been restricted to 1000 MT in the first instance. The import quantities can be enhanced later on by the NC once at least 50% of the exports against each item has been made. HBP The above fixation of adhoc norms is valid for present application under Para 4.06 of & norms are valid for one year from the date of uploading the minutes in DGFT website. No Advance Authorisation should be issued on repeat basis based on the fixation of above mentioned adhoc norms. All Policy conditions including VA, Appendix 4J conditions etc. also to be met, wherever applicable.
