Please Note

{i} For information of ‘cxporters, Norms Committee-VI handles all cases pertaining to fixation/ratifieation of norms for Export Products falling under ITC(HS) Chapter 1 to 26 & 94-98. Communications in respect of cases pertaining to NC-VI may be sent to email address! p.sahu@gov.in

{ii} In certain cases the decision of the Norms Committee refers to the recommendations’ observations’ deficiencies received fram the concerned Technical Authority. Wherever applicable, a scanned copy of such document has been placed at the end of the Minutes, in running serial orders. The concerned firm/company may go through the same and respond accordingly.

(iit) Similarly, @ scanned copy of the blank Standard Deficiency Format, which may find a reference in NC- decisions, has also been attached in the end. This may. also be referred to by the concerned firm/company and may be responded accordingly.
(iv) For information of the exporters, it is informed that wherever DL is issued, the case would be rejected in case the reply of the firm is not received within 90 days from the dateof issue of DL.

(v) The Norms Committee has taken decision only with respeet to technical aspect/wastage norms, While redeeming the applications, RAs should check that the applicant has fulfilled-all requirements as preseribed in poliey/procedure including those in Policy Circulars issued from time te time or any ‘other provisions under FIP/IBP for issuance of AA and » tepularization of the casc.

Decision : NC considered the case as per agenda and noted that for export of Tea Bags with Tea Packed in Cartoons the firm was issued above mentioned AA for import of(i) Nylon/Bio Mesh Pyramids (Filter coils), (ii) Flavor: Liquid/ Granules, (iii) Fruits/Flowers/Herbs/Peels and (iv) Tea. In the earlier meetings i.c., M.No. 19/85 dated 07.02.2019 and M.No. 11/85 dated 12.09.2019, the Committee approved three items except Flavour. Again on the basis of the request of the firm, a personal hearing was given in M.No. 21/85 held on 13.02.2020. The representative ofthe firm appeared for PH. The Committee after due deliberation, asked the firm to furnish following information;

Decision : NC considered the case as per agenda and noted that on the basis of the comments of the Technical Authority, Le, MoFPI, furnished vide OM No, E- 14/01/2020-ED dated 28.08.2020, the firm was issued DL on 09.10.2020 to clarify the reason to transfer the import item to the manufacturing plant of supporting manufacturer, i.c.. Frigorifico Allan Pvt. Ltd. for process of deodorization, storage and supply of the import item again to the firm. The Committee noted that the firm vide email dated 12.10.2020 has clarified that the Refined Palm Olein when imported in Vessel carries some Paroxide value “PV”. ‘The value get increased during transit and storage which takes out the freshness from oil. Being a quality French fries manufacturer they require fresh Palm Olein with certain PV to manufacture their final product and hence they send the material to. supporting manufacturer M/s Frigerifico Allana Private Limited for the purpose of storage and on time delivery of fresh material after deodorization.

The Committee observed that the accounting of import item in export product is difficult. Moreover, the reply furnished by the firm for storage & timely delivery of import item in the manufacturing plant of supporting manufacturer, Le., Frigorifico Allana Private Limited may not meet the framework of the Scheme. Hence. the Committee decided to reject theapplication for prior fixation of norms under Para 4.06 of HBP, 2015-20,
