Please Note

(i) For information of exporters, Norms Committee-VI handles all cases pertaining to fixation/ratification of norms for Export Products falling under ITC(HS) Chapter 1 to 26 & 94-98. Communications in respect of cases pertaining to NC-VI may be sent to email address: p.sahu@gov.in
(il) In certain cases the decision of the Norms Committee refers to the recommendations/ observations/ deficiencies received from the concerned Technical Authority. Wherever applicable, a scanned copy of such document has been placed at the end of the Minutes, in running serial orders. The concerned firm/company may go through the same and respond accordingly.
(iii) | Similarly, a scanned copy of the blank Standard Deficiency Format, which may find a reference in NC decisions, has also been attached in the end. This may also be referred to by the concerned firm/company and may be responded accordingly.
(iv) For information of the exporters, it is informed that wherever DL is issued, the case would be DL.rejected in case the reply of the firm is not received within 90 days from the date of issue of

Decision : NC considered the case as per agenda and noted the reply furnished by the firm vide their letter dated 30.07.2020 in which it has been stated that other than the sterilization activities, there is no other manufacturing activities involved. The firm has a. 12 supporting manufacturer i.e., M/s Dhruhi Sterlie, through which the sterilization. activities are done. The AA has been issued to the firm as a manufacturer exporter, but no manufacturing activity is done by the AA holder. The manufacturing activity i.e. ‘Sterilization’ is being done by a 3“ Party who is a supporting manufacturer to the AA. holder. Such an arrangement is not permitted under FTP. The Committee, therefore, decided to reject the case with direction to the firm to pay the Customs Duty and applicable interest to regularize the case.
