Minutes of the meeting No. 01/17 of NC-VI held on 01.04.2016

Meeting No. 01/17 for the licensing year 2016-17 held on 01.04.2016 to consider cases under Duty Exemption Schemes (Chapter-4) of Foreign Trade Policy 2015-20 pertaining to Food & Mics. Products under the Chairmanship of Sh. S. K. Samal. Jt. DGFT. Following members were present in the meeting.

Agenda for individual cases was taken up for discussion. Decision taken in each case is enumerated below. Ad-hoc norms fixed in this meeting are valid for a period of 2 years reckoned from the date of ratification as per para 4.12(a)(vi) of Hand book of procedure (vol-1) 2015-20 updated as on 01.04.2015.

The representatives of the firm Sh. Indra Singh Rawat, Manager-Export and Sh. Sunil Kumar Arora appeared for PH. Following submissions were made by the representatives before NC for re-consideration of request made by them.

01 (i) The item of import is non Central Excisable one. (ii) The exports are made through factory stuffing under the supervision/control of Central Excise and State Excise.
- (iii) The official of State Excise Deptt. opens the premises at 9.00AM in the morning and the unit is locked and sealed by them at 5.30PM in the evening.
- (iv) 100% export obligation has already been completed.

It was noted that these submissions were also made before NC in its meeting No. 05 dt. 09.07.2015. Hence, in consultation with representative of MFPI present in the meeting, it was decided to maintain the earlier decision which is being consistently taken by the Committee in similar cases.

Request for review of ad-hoc norms fixed by NC

The Committee noted that NC has already fixed the ad-hoc norms in its M.No. 20 dt. 12.02.2015. The firm requested for incorporation of Dia 0.0SMM in export and import item. The firm was asked to indicate the bifurcation of quantity of 0.7mm & 0.5mm dia pencil to be used in export item. The firm vide their letter dt. 08.08.2015 replied that they are not sure about the requirement of buyer as it can be either 0.7mm Dia or 0.5mmDia. NC was of the view that input output norms are to be definite for the quantity of import and export. Hence, the request of the firm can not be acceded to.
