,The P.H. was granted in order to re-look at the issue in the light of facts & data which firm's I
representative was supposed to submit before the Committee to substantiate their claim for wastage. Shri
Ashfak Khatri, Partner of C.B. Industries appeared before the Committee on 18.05.2015. The details ofi
the deliberations made in the meeting are as under:
The Committee noted the following background of the case.
i. M/s C.B. Industries Jamnagar (Gujarat) was issued an Advance Authorization(AA) No.

2410040091 dated I 1.10.2013 for export of 'Processed (Split/Sliced/Flakes/Dried/Frozen)
Betel (Areca) Nuts with or without Scented" against import item "Betel (Areca) Nuts
Whole&/or Split". The import item being barred under para 4.7 of HBP Vol. 1(2009-14)

iii. However, the firm made a representation before DG to review NC's decision and offered to
provide facts and data for their claim of wastage of l2oh on imports.

(c) Committee noted that only 2oh and 5 o% wastage is allowed under SION for Imported item Supari Whole and Supari Split against export of Supari Split/Tukada and Processed Betel Nut Powder respectively. In the instant case, the import item is Betel (Areca) Nuts Whole and/or Split and the export item is Processed ($p!!/sliced/Flakes/Dried/Frozen) Betel (Areca) Nuts. With this broad range of imports and exports, the possibility of both import and export item being the same, i.e. Split cannot be ruled out, in which case there is no wastage involved in the manufacturing process. Allowing lTYo wastage as claimed by the firm will be far in excess of SION. (d) Secondly, the firm had itself applied for AA on net to net basis and the same was allowed as a special case under para 4.7 of HBP vol. I (2009-2014) considering the urgency pleaded by them as the item of import is barred under para4.7 referred above. (e) The representative of the firm claimed wastage citing moisture content as a factor and also the differing size of imported Betel Nut and that exported. However neither of these factors is borne out by the export or import documents produced during the PH. (f) As regards the applicant's argument about wastage based on the payment of Central Excise(CE) Duty on wastage sold, the same is not correlated with the AA in question. Central Excise authority, in their letter dated 19.02.15 (copy placed on record by the firm), have only indicated excise duty rates on the waste materials and have clearly stated that their letter is only for the purpose of charging of CE duty under CE Act. Thus the letter of CE Authority is no evidence of the wastage incurred in the manufacturing process of the export item against the relevant AA. ゆ
