Supplementary agenda The issue relating to import of Cheese in consumer pack against export of Biscuits was taken up by the NC for discussion as DG desired to have Norms Committee ‘s view in the matter in file No. 01/85/162/00171/AM 13/ DESVI. The following points emerged out of discussion. I While the Committee found it reasonable not to allow import in consumer packs in case of AA, the same is not found reasonable in the case of DFIAs. The latter are transferable in nature and therefore products imported hereunder are transferable and their sale in domestic market is legally permissible under the scheme itself. II Secondly, Committee was of the view that the term ‘Consumer pack’ does not have a clear and precise definition because of which it may be a subject of interpretation by the authorities and can be a tool of unwanted subjectivism and discretion of agencies involved in the process of import. III. However , since the intent of the FTP is to allow duty free import of inputs only for export production, import of items in consumer packs which is not related to manufacturing and intended for retailing may not be permitted . To operationalise this ban is of course problematic. as mentioned above. But, the only alternative seems to be leave it to the wisdom of the customs authorities to determine which is in consumer pack. 888888888
