The case was considered by NC meeƟng as per agenda. CommiƩee heard the representaƟve of the firm who was present to explain the case. It was noted by CommiƩee that no accountability can be established between the imported inputs i.e. whether fruit flavours have been used in the export product or not. Moreover, it is observed that fruit flavour consƟtute more than 50% of the weight of the export product , which is, dried flowers & leaves. Fruit flavours are used only in miniscule quanƟƟes for adding fragrance & such large quanƟƟes are unthinkable. CommiƩee therefore rejected the representaƟon of the firm and endorsed its earlier decision of NC36/08 dt.3.1.2008. RLA to take consequenƟal acƟon as per Policy/Procedures.

The CommiƩee considered the case as agenda. CommiƩee observed that it may not be possible to establish actual usage of imported inputs in the export product without the Central Excise CerƟficate (for inputs used in manufacturing export product by their supporƟng manufacture‐ (M/s Maksons PharmaceuƟcals ). Moreover, the export formulaƟon is new & not a standardized formulaƟon & it is not possible to work out admissible qty(s) of different inputs required for manufacture of export product. In the absence of actual consumpƟon details, as cerƟfied by Central Excise, it my not be possible to jusƟfy the usage even though firm has submiƩed an Affidavit –cum‐Indemnity Bond in this regard . Case is therefore rejected and RLA to take consequenƟal acƟon as per Policy/Procedure. +
