Please Note For information of exporters, Norms Committee - V handles all cases pertaining to fixation/ratification of norms for Export Products falling under ITC (HS) Chapter 41 to 43, 50 to 67 .Communications in respect of cases/pertaining to NC- V may be sent to email address: nc5.dgft@nic.in I. The Norms Committee has taken decision only with respect to technical aspect/wastage norms. While redeeming the applications, RAs should check that the applicant has fulfilled all requirements as prescribed in policy/procedure including those in Policy Circulars issued from time to time or any other provisions under FTP/HBP for EODC. II. Wherever the Committee has fixed Norms, the concerned RA may ensure that AA is issued on the wastages/consumption as ratified by the Committee or as per wastages claimed in the application, whichever is less. Norms Committee Decision:

The Committee considered the case as per agenda along with other relevant papers and noted that this case was rejected on the basis of the facts that firm has not made any export against advance authorization. Now firm has requested for fixation of norms and stated that they have another Advance Authorizations for same export product in which they have made some excess export and wants to club the advance authorization with those advance authorizations. In this regard, RA, Bangalore vide email dated 09.02.2024 have intimated that they have issued Show Cause Notices dated 28.10.2020 and 13.01.2022 to the firm regarding non-submission of export documents and DRI have also issued reminder letter dated 30.01.2024. Accordingly, based on the NC-5 decision, RA Bangalore was asked vide this office email dated 11.03.2024 to intimate as to whether any misrepresentation has been done by the firm namely M/s Himatsingka Seide Limited, Bangalore and also intimate as to whether the clubbing of the authorizations as claimed by the firm may be feasible keeping in view of the provisions of then FTP/HBP and show cause notices issued by RA, Bangalore and DRI.

In response, RA Bangalore vide email dated 13.08.2024 intimated that as against show cause notice, the firm has intimated them that they have applied for review of norms to the norms committee and they are waiting for the decision of norm committee. The issue was deliberated and noted that the firm has not made any export against the advance authorization under consideration and further, RA, Bangalore has not replied about the feasibility of clubbing of the authorizations as stated by the firm. Accordingly, based on the deliberations, the committee decided to reject the case, being policy matter regarding clubbing of authorizations and the same is beyond the purview of the Norms Committee-5.

RA concerned may take necessary action subject to compliance of para 4.17 of HBP and other usual conditions.
