Change of SION from J-290 to J-125 for the purpose of closure and regularization of Advance Authorization No.0510075339 dated 13.12.2002 issued for Ladies blouse made of 100% Silk Printed Fabric.

Decision: Committee considered the case as per agenda alongwith other relevant papers and noted that the applicant firm M/s Shivam Global Apparels has requested to look into the matter and instruct CLA to redeem the authorization issued in this case. In this case AA No. 0510075339 was issued by CLA to the firm on 13.12.2002 for import of 1882 SQMs 100% silk Printed Fabric with an export obligation to export 1147 number of Ladies Blouses under SION J-290.

As the Silk is not fallowed against the SION J-290, it was noticed by the CLA that the authorization has wrongly issued in this case. The firm has already imported 1856.45 SQMs 1005 Silk Printed fabric and also exported 1139 Nos silk blouses using 1856 SQMs silk printed fabric and submitted the documents for redemption.

As informed by the firm they had various meeting with the officials of CLA and all of them |

sympathetically appreciated that it was bonafide mistake could have been rectified at the time of issuance of license itself but showed their helplessness to do anything at this stage and advised the firm to take up the matter with DGFT Har for necessary relief. Accordingly the firm vide their letter dated 28.05.2012 requested PRC. The PRC vide their letter No. 01/60/162/AM13 / EFGC PRC) dated 10.10.2012 directed the firm to submit their request directly to NC as it pertains to NC5. Accordingly the firm, vide their letter dated 29.11.2012, requested us to consider the case sympathetically and issue necessary instructions to CLA to redeem the above said authorization. Thereafter vide letter dated 18.01.2013 CLA was requested by NC for status report in this case. As per status report of CLA vide their letter dated 21.02.2013 the above facts provided by the firm appears in order.

In view of above the Committee after deliberations in consultation with representatives of technical authorities present in the meeting agreed to the firm’s request and decided to advise CLA, New Delhi to consider the input output of the authorization issued in this under SION J-125.
