Re-fixation of input output norms in respect of Annual Advance Authorization No. 0310785717

Decision: The Committee considered the case as per agenda alongwith other relevant papers and went through the details submitted in this case. This matter was earlier examined by the committee in its meeting No. 10/AM13 dated 14.06.2013 and approved by the case. Now the firm vide their representation dated 16.02.2015 has stated that they had applied and obtained the above said AA for he 7 \b,

export product “Acrylic Nylon Blended (60% Acrylic content 40% Nylon content) Dyed Yarn Under worsted system but the Nylon Tops (import item) which had returned by “BWK Chemiefaser GMBH, Germany” as the import item was found defective/unfit for use. The firm have provided copy of the S/Bills, invoices, bill of entry and requested to allow “Acrylic Dyed Yarn” proportionately to the quantity re-exported of Nylon Tops which is calculated as 3120 Kgs (60% of 5200Kgs of Acrylic Nylon blended Yarn) wastage norms remains the same for Acrylic content (1.11 Ke/Kg of export product). Vide their letter dated 13.12.2014 Jt. DGFT Office; Ludhiana has asked the applicant firm to approach DGFT hgr in this case. The committee went through the details submitted by the firm in this case and decided to re-fix the norm as detailed below: Quantity allowed BIGHSes Eyed "Yarn | Res ~ - Agent, softener (Hydrophilic/ cationic /Bulky/Silicon), Acetic acid, non-ionic washing agent, Anti-static agent, softener flakes. Misc. Dyes 1005 (Nylon dyes/metal | 278.500 2. Acrylic Dyed yarn | 3110.617 (under worsted | kgs - Agent, softener (Hydrophilic/ cationic /Bulky/Silicon), Acetic acid, non-ionic washing agent, Anti-static agent, softener flakes. The Dyes and Chemicals in respect of import item No.3 to 5 against the subject advance authorization shall be restricted to 14% of FOB value within the overall CIF value of the licence in terms of General Note for Textiles at Sr. No.5 and amended vide Public Notice No.88, dated 27.12.2011.The R.A. shall be advised to take necessary action subject to compliance of other usual conditions.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and went through the details submitted by the firm in this case. There is no record found in online server as the case is very old. The license has already been expired on 10.02.2007 as per condition sheet of the authorization. The firm have now stated that the above said AA had applied and obtained for the export item “Gents Jacket with Lining Garment’ and imp[ort items were (1) P/D Polly twill (100% polyester fabric with or without PU coating) 185 GSM+- 10% fabric(2)Lining fabric 100% Polyester lining fabric 170 GSM+-10% fabric” as per SION J-176 and they have been not made import item no2 as the garment export was a fashion industry and their buyer was changed the specification of order to different design with higher consumption i.e. 6.25 Sqm /pe as the time was limited to export. As per details given by the applicant firm only 2821 Pcs were exported as per SION J-176(Input allowed 2.48Sqm/pc). To avoid cancellation of order and imported raw material in house with Bank guarantee and bond given to customs and they have preferred to execute the order on higher consumption and made export of 9358 Pcs (Consumption 6.25 Sqm/pc). After deliberations with the members present in the meeting the committee decided to fix the input output norms in respect of the authorization issued in this case as per samples and documents like CAD/CAM, Garment Specifications, Mgmt chart & sketch of the export product submitted by the firm as detailed below:

Vide their letter dated 10.03.2015 M/s Naser Bali (Glove) Pvt. Ltd has requested for change the description of export product from “Golf Gloves made of knitted & crocheted fabric with Polyester, Polyamide and Polyolefin”(as mentioned during fixation of norms) to “Golf Gloves made of knitted or crocheted fabric”(as mentioned in above said authorization and all export documents including S/Bills) in Adv. Authorisation No. 0410145239 dated 17.04.2013. After deliberations with the members presented in the meeting the committee agreed to request of the firm. Therefore the export description against AA No. 0410145239 issued on 17.04.2013 and ratified by norms committee in its meeting held on 30.05.2013 may be read as “Golf Gloves made of knitted &crocheted fabric’.
