Minutes of NC-V meeting No.43 held on 26.02.2015

The meeting No.43/AM-15 for the licensing year 2014-15 to consider the cases under Duty Exemption Schemes (Chapter-4) ) was held on 26.02.2015 in Conference Room No.11 of DGFT under the Chairmanship of Shri K.C. Rout, Addl. DGFT. The following officers were

At the outset, it was pointed out by Shri Barinder Singh, Assistant Director and Technical Member of DC (MSME) that the GSM/lea in such cases of Export product Fabrics (Flax /linen) made from yarn should not match. Accordingly, committee decided to issue a corrigendum for deleting the same condition from those cases of M/s Bombay Rayon Fashions limited which were recently ratified by the committee with this condition. Thereafter the Minutes of NC-V Meetings No.39/AM-15 dated 29.01.2015 & 40/AM-15 dated 05.02.2015 were taken up for ratification. As there was no amendment to the same, the above referred minutes were adopted for implementation by the Committee without any amendment. Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that the case is under examination of DIPP. The DIPP has issued a deficiency letter to the firm. The firm has sought some time for reply of the DIPP’s letter. Therefore it was decided to await the same and defer the case for re-listing on 26.03.2015.

A deficiency letter has also been issued to the applicant firm by D/o C& PC on 29" Oct, 2014. Now the firm vide their letter dated 27.01.2015 as stated that they had imported 100% Polyester Printed Fabric GSM 115 and 100% Polyester Dyed Fabric GSM 100 (S.No. 1&2) of li9cence iport item list for export of 34850 Nos. of Girls Dress made of 100% Polyester Printed fabric GSM 115with 100% Polyester Dyed fabric, GSM 100 (S.No. llicence condition Sheet). Since the buyers have reduced the garment order quantity from 34850 Nos to 20500 Nos. and they had canceled the remaining garment order quantity i.e. 14350 Nos. cancelled. As per their buyers revisedorder quantity they had fulfilled the export obligation. i.e. 20500 Nos of Girls Dress. They have left out fabric of 31570 Sqms of 100% Polyester Printed fabric, GSM 115 nd 21812 SQMs of 1005 Polyester Dyed fabric GSM100. Further stated that they had tried to re-export the above mentioned left out fabrics to their foreign supplier. But they refused to take back the fabrics. They have approached their foreign buyer and requested them to provide orders. As per their request they have placed 9368 Nos of Ladies dress made of 100% Polyester Printed fabric, GSM 115 and10640 Nos of Ladies Shirt (full sleeve made of 100% Polyester Dyed fabric GSM 100. As stated by the firm they have now taken the licence EOP extension upto 31.05.2015 to effect above export under AA stated above. They Hes<requested to re-fix the norms (change of export items) for SI. No. 1 of licence condition sheet as per the details below to enable them to fulfill export obligation of the above licence. It was decided to defer the matter to DC (MSME) for their examination and written comments. The case was deferred for relisting on 26.03.2015.

Ratification of input output norms in respect of Annual Advance Authorization No. 0510268422 dated 19.07.2010.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that the applicant firm has not submitted the required information/documents to DGFT for fixation of adhoc norms. This matter was last examined by NC in its meeting held on 29.01.2015 and that time it was decided to call the applicant firm for personal hearing before NC alongwith sample of the export product, all export documents, complete justification and technical person to explain the case. Neither any person of the firm appeared before the committee nor any response received from them in this regard. Therefore committee was constrained to reject the case.

Decision: The Committee considered the case as per agenda alongwith other relevant papers. Since there is no record found in online NIC server as the licence is very old, (approximately 14 years old) it was decided to ask the RA concerned for the status report of this case to enable us to process the matter further for fixation of norms. It was decided to defer the case for relisting on 26.03.2015. |
