At the outset the Minutes of NC Meeting No. 37/AM11 dated 09.12.2010, Meeting No. 38/AM11 held on 16.12.2010 and 39/AM11 held on 23.12.2010 were ratified. Thereafter agenda for individual cases for Meeting No. 40/AM11 dated 30.12.2010 was taken up for discussion and the decision taken in respect of each case is enumerated below:

In view of the above Committee after deliberations in consultation with the representatives of technical authorities present in the meeting decided to ratify the Advance authorization issued in this case as detailed below: - (i) The item of import at S.No. 1, 2, 3, 4, 5 and 6 against the respective export item at S.No. 1, 2, 3, 4 and 5 may be allowed as per SION, J-275 i.e @ 2.25 Sq mtrs./Pc. (ii) Since, no justification in respect of import item at S.No. 6 and 7 have been given , hence disallowed.
The GSM should match in both import and export. The R.A shall be advised to take necessary action subject to compliance of other usual conditions.

In view of this Committee was unable to re-consider this case. Hence, decided to maintain status quo in this case.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and observed that firm have neither justified the higher quantitative requirement of input. Further, there is no documentary evidence corroborating the facts that applicant firm have exported the size range 38, 40, 42, 44 and 46 and average size is 44. In view of this Committee was unable to re-consider this case. Hence, decided to maintain status quo in this case.

Decision: The Committee considered the case as per agenda alongwith other relevant papers and after detailed deliberations in consultation with representatives of technical authorities present in the meeting decided to ratify the advance authorization issued in this case as per written comments of DIPP vide their letter dated 06.01.2011 as detailed below: -
(i) The item of import from S.No. 1 to 5 & 13 may be allowed as per SION, G-45. (ii) The item of import from S.No. 6 to 12 may be allowed on net to net basis with accountability clause. (iii) The Leather Chemical may be allowed as per SION, G-7 taking into consideration that 4 Sq ft. of leather is required for 1 pair of export product.
The R.A shall be advised to take necessary action subject to compliance of other usual conditions.
