  1.     It was also mentioned in the letter dated 4.6.2009 that DRI has already issued Show Cause Notice to company on 25.3.2009 after
    

qualifying the amount of customs duty evaded by the firm. However, since LGMFA is an export product shown against the licences at Sl. No.21 & 22 above, DRI has no issue in respect of these two licences. DRI stated that M/s VVF Ltd, Mumbai have mislead the Norms Committee (NC) as the representations and declarations made by the company before the NC on 21-1-2009,11.2.2009 and 29.4.2009 are fraudulent. As M/s VVF Ltd.

As M/s VVF Ltd. mis-declared, NC approved excess ad hoc norms to import duty free raw material far in excess of their actual requirement. It enabled the company to divert some amount of distilled Fatty Acid for manufacture of soaps which were sold in the local market and also to sell considerable amount of Refined Bleached and Deoderised (RBD) Palmoline imported duty free, in the local market.

  1.     It is noted that the company had obtained the above mentioned 22 advance licences and it requested for ad hoc norms from time to time
    

under Para 7.5/4.7 of relevant HBP on self declaration basis. The NC considered the proposal under Para 7.5/4.7 of relevant HBP on the basis of

PRO version self declarations made by the company and fixed ad hoc norms accordingly. On the directions of the Hon’ble Settlement Commission, Mumbai conveyed by the Zonal Jt. DGFT, Mumbai vide their Letter No.F-3/10/AM07/DRI/ECA-II/792, dated 25.11.2008, ad hoc norms decided against the above mentioned 22 advance licences were reviewed and re-fixed on the basis of revised declarations made by Company in the meeting of the NC held on 21.1.2009, 11.2.2009 and 29.4.2009. Personal hearing was given to CMD and other representatives of M/s VVF Ltd., Mumbai on 21.1.2009, 24.4.2009 and 29.4.2009. On 29.4.2009 CMD, M/s.

VVF Ltd., Mumbai stated that the company had completed revamping and modification of their plant by way of installing additional fractioning columns from years 2001-02 to 2005-06. It was also stated in the written submissions made by the firm on 29.4.2009 that due to investment made in the plant and machinery, quality of Low Grade Mixed Fatty Acid (LGMFA) improved and therefore value of this product enhanced. The firm further stated that the value of the improved LGMFA enhanced by Rs. 4000/- per MT [It may be mentioned here that in the past declarations at the time of fixation of Norms from time to time they had declared value of LGMFA as Rs.1000/- per MT]. In the Personal Hearing given to the CMD of M/s VVF Ltd. On 11.2.2009, he had submitted a CA Certificate relating to additions in specific plant and machinery as below:

However, keeping in view the directions of the Hon’ble Settlement Commission, Mumbai the ad hoc norms were relooked in the meeting of the NC on 29.4.2009, which was represented by the Technical Authorities from the Department of Industrial Policy and Promotion and Department of Chemical and Petro-chemicals.

This included, investments made by the company towards plant and machinery [on the basis of various Annual Reports of M/s VVF Ltd.], installation of Fractional Distillation Columns in the factory in question, nature and quality of so called LGMFA, value of so called LGMFA (as per Cost Audit Report of Company). In view of the new facts brought out into the notice by DRI, it was decided to reopen the case in Norms Committee. The case was reopened and placed before the NC. The NC in their meeting dated 15.7.2009 decided to grant reasonable opportunities both to representatives of DRI and company to appear in person with all related documents and evidence before the next meeting of the NC on 22.7.2009. Letters were accordingly written to both parties. Ms. Aarti Saxena, Dy. Director and Shri Gavin D’Mello, Intelligence Officer from DRI appeared before the NC. From the company side Shri Rustam G Joshi, CMD, Dr. B.R. Gaekwad, Executive Director Oleochemical, Shri Jagmohan Aggarwal, Director Finance, & Shri Biju George, Dy. GM(Production) availed opportunity of Personal Hearing on 22.7.2009.

the Annual Reports that actual investment made in plant and machinery in different years was entirely different than that declared by the company in their CA Certificate and produced before NC on 11.2.2009. As per printed Annual Report of Company, substantial investment of Rs.21,83,91,256/- was made in the plant and machinery in the year 2000-01 for technology absorption, adoption and innovation. It is mentioned under Para B (5) in Annexure I of Annual Report of company for the year 2000-01 that:

DRI brought into notice that in the official website of M/s VVF Ltd. it is mentioned against “year 2000 that the company commissioned Sulzer Plant for Fraction Fatty Acids in Mumbai [www.vvfltd.com]”. When asked regarding their mis-declaration before the NC on 11.2.2009 that does not match with their Annual Report, Chairman, M/s.

under Section 108 of the Customs Act, 1952 wherein he stated that : “The Lurgi Distillation Plant and the DAG Massoni Distillation Plant were old plants set up in 1980s and I used to assist in the overhauling and process troubleshooting. The Sulzer Distillation/Fractional plant consisted of three columns named as K1, K2 and K3. One of the columns K3 was set up some time in 1997-98 and the other two columns K1 and K2 were already installed in 2001 when I joined and were commissioned towards the end of 2001. I helped in optimizing and trouble shooting of this plant. These three columns in Sulzer Plant can run in various combinations”.

used for manufacture of soap. M/s VVF Ltd, Mumbai submitted a schematic flow diagram depicting the process of conversion of LGMFA to Distilled Fatty Acid. This process apparently entailed a processing cost of about Rs.20374 for conversion of 1 MT of LGMFA to 1 MT of Distilled Fatty Acid [Low Grade]. However, they claimed that this end product is still not suitable for manufacture of soaps as only premium quality Distilled Fatty Acid could have been used for manufacturer of these soaps. This is also a contradiction in the schematic flow diagram. DRI stated that investigations from the authorised persons of the Brand Owners of the soaps firms confirmed that only premium quality Distilled Fatty Acid had been used for manufacturing of soap noodles. They submitted that LGMFA was a byeproduct having very low commercial utility which was being disposed off at the rate of Rs. 1000 per MT. DRI investigations show that pitch/residue has actually been sold under the invoice showing sale of LGMFA at the rate of Rs.1000 per MT. In the NC meeting dated 22.7.2009 when faced with their own Cost Audit report for soaps and detergents M/s VVF Ltd, Mumbai submitted a flow diagram for reprocessing of LGMFA to DFA along with its costing. The submissions show a processing cost of Rs.20374 was required to convert I MT LGMFA to 1 MT of DFA, which as per flow diagram is Distilled Fatty Acid – Low Grade [Not suitable to manufacture quality soaps]. Commercial prudence would never allow such an activity to be carried out over such a long period of time.

From their Annual Report it was seen that subsequent major investments in plant and machinery were made at their other locations or in respect of energy efficiency/conservation. Annual Report of M/s VVF Ltd. clearly indicates that M/s VVF Ltd. was capable of manufacturing high purity fatty acid since April 2001. DRI also produced statement of Dr. DN Bhowmick, Professor and Head of Department of Oils, Oleochemicals and Surfactants Technology, Institute of Chemical Technology, Mumbai (whose opinions had also been used by M/s VVF Ltd. to mislead NC earlier) who admitted in his statement recorded under Section 108 of Customs Act 1962 that “his opinion had been misused by M/s VVF Ltd. and that after taking into consideration the free Fatty Acid content of the raw materials used by M/s VVF Ltd. the wastage would have been in the range of 5% to 10%.” 16.
