  1.     The Committee considered the case as per agenda. The office of Zonal Jt. DGFT, Mumbai vide their letter No.F-

3/10/AM07/DRI/ECA-II/792, dated 25.11.2008 informed D.G.F.T.Headquaters that an application has been filed by M/s VVF Ltd., Mumbai before Hon’ble Settlement Commission, Mumbai and Hon’ble Settlement Commission has asked for advice from DGFT on the question of cancellation of licences/modification of ad-hoc norms as requested by DRI. The case was therefore placed before Norms Committee.

  1.     As per the DRI report, the party had claimed higher wastage in the form of higher residues/Pitch & formation  of Low Grade

Mixed Fatty Acids (LGMFA). The sale price of recoverable wastage (LGMFA) as indicated in their application is Rs. 1000 per MT.

  1.     To ascertain the facts of the case, the applicant party was called for personal hearing by the Norms Committee  in its

meetings held on 21.1.2009, 11.2.2009 and 29.4.2009. The firm while giving revised data vide their letter dated 29.4.2009 clarified that they have installed K3 Single Fractional Distillation Column with Sulzer’s structured packing mellapack during march 2001for the manufacture of high purity fatty acids. The trial runs were carried out during April – July, 2001. They have mentioned that before the commencement of operation of the same, there was no possibility of recovering any valuable product from LGMFA.

  1.              On encapsulating  the history of clearance of the cases by ALC in respect of Licence No.310045711, dated 18.7.2000, it is

mentioned that against their licence application was received in 2000, the representatives of the firm was called for Personal Hearing before ALC meeting held on 30.8.2000. Details of minutes of the ALC meeting held on 30/8/2000 are reproduced as below:- “The Committee considered this Para 7.5 case as per agenda for fixation of norms for the export product Refined Glycerine. The party was called before the Committee for personal hearing, Vice-President of the company appeared before the Committee. He was requested to explain the reasons for formation of high quantity of low grade mixed fatty acid and also to give proof for sale of the same at a price of Rs. 1000-MT. The representative of the company explained that during the fractional distillation about 50% of good quantity of fatty acid gets polymerized. He explained that they are in the process of installing additional fractional distillation columns which will help in generation of high grade fatty acids & that for this they have incurred expenditure worth Rs.6/-crores. He assured the Committee that in future they will get better quantity of high grade fatty acid after installation of additional equipments.

The Committee accepted their contention and decided to clear this Para 7.5 application as applied for as follows:-

  1.              Later on, the party  again appeared for Personal Hearing on 28.3.2001 before ALC  with regards to Licence

No.0310072061 dated 7.2.2001 and submitted a detailed note containing plant up gradation and their current status of fatty acid distillation plant. The minutes of the meeting ALC No. 42/2001 dt. 28.3.2001 are reproduced below:-

The Committee after hearing the submissions of the representatives of the firm about the reduction of wastage during this period and also their further submissions to reduce the wastages in future and also in the light of the written comments of the Deptt. of C&PC furnished vide their U.O. Note No. 14010/87/2000/CH.II dated 28.2.2001 a copy of which was also given in the meeting recommending a quantity of 10594 MTs. RBD Palmolein, having FFA=0.1%, AV=0.3% and SAV=198 as against 12300 MTs of RBD Palmolein asked for, for the purpose of the above advance licence, decided to clear the case as per the written recommendation of the Deptt.

  1.    On 29.4.2009 CMD of the firm stated before Norms Committee that  in the beginning , they were having  simple one

distillation column and due to repeated distillation carried out, wastage was higher. He also stated that firm has completed revamping and modification of their plant by way of installing additional fractioning column from 2001-2002 to 2005-2006. Norms Committee felt that at this stage past physical verification of wastage cannot be done and therefore revised declaration given by the firm was considered.

  1.     In a written submission made by the firm on 29.4.2009 it is stated that due to investment made in plant and machinery quality

of LGMFA improved and therefore value of this product also enhanced. The firm submitted in writing that value of the improved LGMFA enhanced by Rs. 4000/- per MT. On the basis of enhanced value as submitted by the firm, back calculation was done and

  1.     Firm also submitted that Acid Oil is black /dark brown color obtained from the vegetable oil refinery. It is mixture of Fatty

Acids, Glycerides and unsopanifiabels as main constituents. It contains maximum impurities & recovery of Erucic Acid & Behnic Acid is very difficult resulting in formatting of substantial wastage. Firm further stated that LGMFA recovered from Acid Oil is of highly impure form, Norms Committee concurred the submission made by firm.

  1.    In view of the above Norms Committee decided the following:-

(i) Firm’s declaration of no possibility of recoveries of any valuable product before substantial investment in plant and machinery is accepted. Thus Norms worked out earlier in case of first seven licences ( Sl.No.1 to Sl.No.7 mentioned in DRI report) on basis of declaration of the firm are retained. (ii) Statement of firm that “Acid Oil” with respect of licences at Sl.No.14, 18, 19 (of DRI report), contains mostly impurities and LGMFA recovered from Acid Oil is in highly impure form is accepted by the Norms Committee.

(iii) On the basis of revised declaration given by firm on 29.4.2009, revised norms in 8 licenses (Sl.No.8,9 ,11,12,13,15,16 and 17) have been worked out and given under Column No.(7) of Para 8 above. (iv) The norms granted in Licence No.310317464 dated 18.2.2005 at Sl.No.20 is amended to 1.162 kg as against approved (earlier) norms of 1.166 kg in line with SION fixed later on.

PRO version 11. Normally Norms Committee does not review the norms decided 7-8 years before. Norms, earlier were decided on the basis of Para 7.5/4.7 of relevant Hand Book of Procedure on self declaration basis. These norms have been re-looked into, keeping in view the directions of the Hon’ble Settlement Commission, Mumbai conveyed by the office of Zonal Jt. DGFT, Mumbai vide their letter No.F-3/10/AM07/DRI/ECA-II/792, dated 25.11.2008 and self declaration of the firm on 29.4.2009.
